We sometimes withhold information when we believe that reporting it would threaten a life. In this case, we believed, based on our talks with many people in the government and on our own reporting, that the information on the Treasury Department's program did not pose that threat. Nor did the government give us any strong evidence that the information would thwart true terrorism inquiries. In fact, a close read of the article shows that some in the government believe that the program is ineffective in fighting terrorism.
In the end, we felt that the legitimate public interest in this program outweighed the potential cost to counterterrorism efforts.
Some readers have seen our decision to publish this story as an attack on the Bush administration and an attempt to undermine the war on terror.
We are not out to get the president. This newspaper has done much hard-hitting reporting on terrorism, from around the world, often at substantial risk to our reporters. History has taught us that the government is not always being honest when it cites secrecy as a reason not to publish. No one believes, in retrospect, that there was any true reason to withhold the Pentagon Papers, although the government fought vigorously to keep them from being published by the New York Times and the Washington Post. As Justice Hugo Black put it in that case: "The guarding of military and diplomatic secrets at the expense of informed representative government provides no real security for our Republic."
I don't expect all of our readers to agree with my call. But understand that it was one taken with serious reflection and supported by much history.
Having a prescription bottle with someone else's name on it is actually enough to be questioned and detained. Rush might not be the only one in trouble over this thing.
The privacy excuse is completely ridiculous. Privacy is protected under HIPAA. No pharmacist in his or her right mind would leak it if Rush was on Viagra. Rush could sue the hell out of anyone leaking it and the pharmacy/doctor's office, and those folks could lose their licenses.

RE: Hippa - absolutely right. Patient confidentiality is absolutely covered with pharmacies. Violations result in penalties exceeding $10,000 (I believe it may be more).

The article is misleading when it states that the prostitutes are automatically considered the employees of their pimps. Many years ago I was involved in a civil suit which presented the question of whether prostitutes were independent contractors or employees for purposes of employment taxes. While there were some interesting depositions, the answer to the question was not as clear cut as you might think. And even if the prostitutes are considered employees, the "employer" is the one who pays them their "wages". If the customer pays the prostitute directly, the customer is considered the "employer" and must file an employment tax return (even if the prostitute then pays some of the money to the pimp). So is Grassley going to have the IRS chase down the customers for failing to file employment tax returns?

We considered very seriously the government's assertion that these disclosures could cause difficulties for counterterrorism programs. We sometimes withhold information when we believe that reporting it would threaten a life. In this case, we believed, based on our talks with many people in the government and on our own reporting, that the information on the Treasury Department's program did not pose that threat. Nor did the government give us any strong evidence that the information would thwart true terrorism inquiries. In fact, a close read of the article shows that some in the government believe that the program is ineffective in fighting terrorism.
In the end, we felt that the legitimate public interest in this program outweighed the potential cost to counterterrorism efforts.
Some readers have seen our decision to publish this story as an attack on the Bush administration and an attempt to undermine the war on terror.

History has taught us that the government is not always being honest when it cites secrecy as a reason not to publish. No one believes, in retrospect, that there was any true reason to withhold the Pentagon Papers, although the government fought vigorously to keep them from being published by the New York Times and the Washington Post. As Justice Hugo Black put it in that case: "The guarding of military and diplomatic secrets at the expense of informed representative government provides no real security for our Republic."
I don't expect all of our readers to agree with my call. But understand that it was one taken with serious reflection and supported by much history.

The documentary "The Corporation" (which I saw and brought the DVD) does an examination into companies such as Merck and Pfizer and how they got around lawsuits and how they profit. I was just pointing out other pharmacutical companies that do sponsor Rush as an example that this is just a business. Many of the companies today have gotten away from what they are truly marketing and the consumer's bottomline and simply are looking for profits. I am sure that Rush got free Viagra from Pfizer. The question for Henninger and the Journal now is whether they will stay mum, given that the Journal's own news division reported as follows: "[T]he U.S. Treasury Department has been secretly tracking suspected terrorist financing through a far-reaching program that gives it access to records from the network that handles nearly all international financial transfers."
On June 27, Editor & Publisher magazine raised a similar question of the Journal:
The paper's Editorial Page Editor Paul Gigot declined to comment when asked if he planned to editorialize on the Journal's decision to publish the story, saying in an e-mail message through [Journal spokesman Robert] Christie that he does not discuss pending editorial subjects. Whatever he produces will be interesting, given the paper's conservative and pro-Bush editorial line.

Any physician who wrote a prescription for a patient under his own name (the docs) would be putting his medical license on the line.
A prescription is a legal medical document and is subpoenable in a court of law.
RE: Hippa - absolutely right. Patient confidentiality is absolutely covered with pharmacies. Violations result in penalties exceeding $10,000 (I believe it may be more).
Anyone in the medical field is very very aware of Hippa - and it IS enforced rigidly.
There also seems to be some question as to whether it was Viagra in the bottle. It doesn't take a rocket scientist to replace blue Viagra with blue OxyContin (Limpballs drug of choice). Both are blue although shaped differently.

AP chose to ignore the scores of scientists who have harshly criticized the science presented in former Vice President Al Gore’s movie “An Inconvenient Truth.”
In the interest of full disclosure, the AP should release the names of the “more than 100 top climate researchers” they attempted to contact to review “An Inconvenient Truth.” AP should also name all 19 scientists who gave Gore “five stars for accuracy.” AP claims 19 scientists viewed Gore’s movie, but it only quotes five of them in its article. AP should also release the names of the so-called scientific “skeptics” they claim to have contacted.

What a bunch of crap. I agree that the IRS should go after the pimps, in particular the "financial" pimps who illegally grease the wheels of politics. There is no reason to spend lots of IRS resources going after the pimps that Grassley talks about. Let the local Vice squads take care of them.
The article is misleading when it states that the prostitutes are automatically considered the employees of their pimps. Many years ago I was involved in a civil suit which presented the question of whether prostitutes were independent contractors or employees for purposes of employment taxes. While there were some interesting depositions, the answer to the question was not as clear cut as you might think. And even if the prostitutes are considered employees, the "employer" is the one who pays them their "wages". If the customer pays the prostitute directly, the customer is considered the "employer" and must file an employment tax return (even if the prostitute then pays some of the money to the pimp). So is Grassley going to have the IRS chase down the customers for failing to file employment tax returns?
Unbelievable. I guess Grassley would rather have the IRS do the work of local vice squads instead of investigating Grover and his crowd.
