I think what we should all do for now on if we are going to pass on a sensitive pic or a video to just add a comment that says: Warning this may sensitive to watch or see. That way that person can decide whether to look at it or not. And if they decide to view it then they cannot come back and say that there weren't warned. So, I will do that for now on because I don't anyone on the blog complaining to me or feeling uncomfortable. BTW, I got that pic from Americablog.It is posted on their blog.

It appears that the zion stepsoldier, Lewis Irving Liebowitz is using the graymail strategy to try to get his case all thrown out.

Still to this day, he persists using this strategy.

Mel Sembler, a clear neocon crook is trying to get his friend Scooter off the hook.

This is an obvious tactic and ploy by anyone with real understanding of law....

One can not dismiss it out of hand however, since convincing Judges of that defense could be very bad.

More on the history of the Libby defense...

"Classified" information is not too relevant to this case. Lewis Libby used faulty memory defense. How will classified material on CIA ops help him jog his memory?

This is a crazy strategy to watch in court.

Maybe feed the rope out a bit more to let him hang......and then drop some new developments in the leak case. Bring them in to testify against Liebowitz.

I think human torture is totally uncalled for and it upsets me greatly that our gov't approves & allows it!

How barbaric and cruel this world has become! And, a majority of those people who approve of it... claim to be Christians! A TRUE Christian, that believes in God and accepts that we are ALL God's children, does not do such terrible things!

I want to clarify that I am not upset with you guys (GEF & SPB)...I am upset at our gov't. And, I do realize that so much is censored from the publics view.

I can only hope and pray that we the people of this country can make the necessary changes, in November, for the sake of all mankind!!

'NYT' Sunday Preview: Ken Mehlman is 'Anal-Retentive, Man!' Says Karl Rove


NEW YORK In the upcoming issue of The New York Times Magazine this Sunday, political reporter Adam Nagourney profiles Ken Mehlman, chairman of the Republican National Committee. It kicks off under the headline “Lost Horizons” with the deck, “When Ken Mehlman took over the Republican Party, his goal was to secure a G.O.P. majority for decades to come. Now he’s just trying to survive November.””

An advance copy of the issue sent to E&P contained a rather amusing typo in a description of Mehlman’s upbringing, in which he is described as “the son of a certified public account.”

Nagourney notes that while the GOP chief just turned 40, “there are dark bags under Mehlman’s eyes now.” In recent weeks he adds, Mehlman, “who never seemed to take pleasure in the kind of sledgehammer attack that [Karl] Rove so clearly savors” has resorted to “searing partisan attacks.” This past summer, Nagourney observed that Mehlman’s usual “bouncy confidence” was missing when they discussed the fall elections. But Mehlman tells Nagourney: “I’m not flipping out.”

Nagourney relates: “His White House colleagues and friends poke fun at his obsession with order and measurement, at his daily spreadsheet of to-do lists.” He quotes Karl Rove on Mehlman: “He’s anal-retentive, man!”

In any case, Mehlman felt the results of two key early contests in this cycle – the race for Duke Cunningham’s open House seat in California and the recent GOP primary for U.S. Senate in Rhode Island – were “encouraging.”

One lengthy section of the article looks at Mehlman’s attempts to attract African-American candidates and voters, which Nagourney calls “a recurring frustration of his chairmanship,” perhaps doomed by the White House’s performance post-Katrina. Nagourney writes that black leaders don’t question Mehlman’s sincerity, but Sen. Barack Obama says that what President Bush and Mehlman “are not not willing to do is fundamentally change a set of priorities, or reorient their party, in a way that is actually going to help the African-American community get ahead.”

The article also touches on the “at once cooperative and competitive” relationship between Mehlman and White House political boss Rove. “Mehlman’s friends voice private frustration,” Nagourney writes, “at just how much credit Rove drew for the campaign of 2004, though Mehlman is far too disciplined and corporate to concede any such resentment.”

If I were Fitz, I would ask little Scooter what is his children's birthday, his wife's birthday, and their anniversary on the stand. I realize that a lot of people work long hours and have stressful jobs and may forget things. But, the timeline of the leak case will show that little Scooter was too engrossed in the CIA covert, Valerie Plame than what he is leading on to the media and public. And there is no way that he says that he can't remember Ms. Wilson's employment. Give me a break! Anyone in any professional field has to carry or have a daily planner! Libby wasn't that dense.. And he is attorney for goodness sakes. You have to keep a daily planner with you. Hell, I even have Franklin planner for professional reasons and personal! The Gilligan defense is his only lameduck way of trying to beat the rap. But, no matter how much classified information or writings from a planner that he tries to dig up, the fact remains is that he lied to Fitz and the GJ. There is nothing wrong with this man's memory except he used a sorry ass defense and is wasting the court's time. Libby was drawing two paychecks from two different positions in the WH. And his memory is just as normal as mines!

NEW YORK - Venezuelan President Hugo Chavez visited a Harlem church Thursday and promised to more than double the amount of discounted heating oil his country ships to needy Americans. He also took another swipe at President Bush. A day after he called Bush "the devil" in a speech to the United Nations, Chavez said of the president: "He's an alcoholic and a sick man."

I had to chuckle at his comments about the Gerbil being an alcoholic and a sick man! My comments? I'll leave it alone. As, Randall Sanborn says: No comment!

WASHINGTON - The judge in the CIA leak case ruled Thursday that if Special Counsel Patrick Fitzgerald feels that admitting certain classified documents at the upcoming trial of I Lewis "Scooter" Libby can jeopardize national security, Fitzgerald can then move to dismiss the perjury charges against Libby.

Judge Reggie Walton cannot automatically allow classified materials to be admitted at trial. He first must go through a series of closed hearings under CIPA regulations. CIPA, the Classified Information Procedures Act, protects and restricts the discovery of classified information in a way that does not impair the defendant's right to a fair trial. It also allows the government to propose a redacted version of a classified document as a substitution for the original, having deleted only non-relevant classified information.

In his ruling this morning, the Judge Walton, has given a technical legal victory to Libby's attorneys concerning the admissibility of classified materials they want to present at trial for their defense.

Victory for Libby
Walton disagreed with Fitzgerald and favored Libby's attorney's argument that in reviewing the classified material to be presented at the hearing, he must simply apply the Federal Rules of Evidence.

Walton also suggested that, "if the government is still not satisfied that the classified information is adequately protected at the conclusion of these hearings, the government has the power to preclude entirely the introduction at trial of the classified information. While invocation of this option may require dismissal of this case."

Walton argues against adopting the balancing test proposed by the government, because it, "could infringe on the defendant's constitutional right to put on a defense by preventing him from introducing relevant and otherwise admissible evidence at his trial because the government's interest in nondisclosure was considered of greater significance."

Crush of national security work
While is it not publicly known which classified materials are at issue, Libby's attorneys have requested and have been given in recent months two batches of summaries and redacted versions of classified morning intelligence briefings which Libby attended with Vice President Cheney in 2003.

Libby's attorneys wish to present at trial a picture of their client as being overwhelmed by the crush of critical national security work at the White House — a client who may have misremembered, what they wish to portray as insignificant, the identity of former ambassador Joseph Wilson's wife, Valerie Plame who was a CIA employee at the time. Using certain classified documents at trial his lawyers could underscore that Libby was involved with important work at the time of the Plame leak.

SPB and GEF I just read the comments about Libby. Now I was thinking this could back fire on Libby. By saying he was over worked with national security work and the dates of the attack on Mr. Wilson one might think that the Wilson matter was indeed important as it put a hole in the lie the Administration was giving to the public and the UN. At that time what was more important keeping the public focused on war or stopping Wilson from bring drought to going to war. As to date most of the stories that Bush gave to the public have been found out to be wrong. Why did some many journalist get this classified information before it was declassified. Why did Rummy said the invasion of Iraq was about oil not Iraq freedom or WMD. Why did Cheney said that Libby was capable and competent in his job if his memory was a wacko. What other mistakes caused the death of our troops because of Mr. Libby's memory problems. Are their any other employees or Administration appointees with the same medical problem of memory lost.
Can Abramoff, Cunningham use that defence on their appeals. Can Tom DeLay use that in his criminal case. Can Ken Lay who is hiding on the island use that in his appeal. Can the American taxpayers stop paying taxes and say they have that medical condition of memory lost.

USA Today aka McPaper...Prosecutors oppose the use of many documents, saying Libby is trying to torpedo the case by demanding information that is too sensitive to be released at trial. The tactic they described, known as "graymail," is used to get a case dismissed.

Among the documents Libby wants to use at trial, attorneys said Friday, are records related to former Ambassador Joseph Wilson's trip to Niger. Wilson, Plame's husband, discounted reports that Saddam Hussein's regime had an agreement with the African country to buy uranium for a nuclear weapons program — a claim that Bush later included in his State of the Union address.

Plame believes White House aides revealed her CIA status as retribution for her husband's accusation that the Bush administration twisted prewar intelligence to exaggerate the Iraqi threat.

Special Prosecutor Patrick Fitzgerald investigated that for three years and did not charge anyone with violating the law that makes it a crime to disclose the identity of a covert CIA agent.

CC- Yeah, too true-but perhaps his suit isn't impeachment proof;-) lot's of interest in that-MD had a table in DC and they were getting lot's of signatures. It can be done through the house bypassing the usual committees and the GOP has lost the House-and they know it;-)

Regarding Abramoff: He is now scheduled to report to prison on October 2nd, 2006.

Rove will be next but it is matter of which graft that he get caught for good: CIA leak or voting rigging or domestic Spying or phone jamming.

Chavez stepped up to the plate last year and delivered heating fuel to the poor but it wasn't just Harlem (you really lead to people to assume things by saying "Harlem"), it was on the East Coast...white poor people. Would the rich thugs of Exxon-Mobile, BP, or other companies? Hell no.

Perhaps you should look for resources on Chavez beyond what Bush tells you.

Get your facts straight. Chavez was in Harlem when he spoke about helping poor. He spoke at the Mount Olivet Baptist Church. Poor is poor whether a person is white, black, blue, etc. Perhaps you should get your facts straight or report to the person that is paying you! Get a life!
