I Love It...

the criminal and civil one-two!
To help Ambassador Joseph Wilson and Valerie Plame Wilson pay for the substantial legal costs associated with the illegal leaking of Mrs. Wilson’s classified CIA status. This includes:
  • Counseling them for their potential witness testimony during the upcoming trial of Scooter Libby; and

  • Helping them to prepare for a civil suit that would uncover the truth surrounding the leak, ensure all relevant public officials are held accountable for actions depriving the Wilsons of their privacy and constitutional rights, and serve as a deterrent to similar crimes being committed in the future.
Should the civil action result in a payment to Joe and/or Valerie Wilson that is in excess of all costs associated with their legal activities, the equivalent of all monies contributed to the Trust will be returned to the Trust. All Trust money will then be distributed by the trustees to a charitable organization(s) that works to protect government whistleblowers’ First Amendment rights and helps to defend them from retaliatory action.

By Joe and Valerie Wilson coming out with a civil suit against Porkrind, Smurf, Baron, and 10 John Does, the release of Novak's false confessions, and the upcoming little soldier's trial next year, you best believe people will be talking more and more about a WH conspiracy. And what great timing before November elections! This is not good for Team Libby's defense to hear their client is named in a civil lawsuit. And not the smurf has to cough up more money to fight a civil lawsuit! But, pay back is certainly a bitch for the Gerbil Administration! The Administration are getting what they gave out to the Wilsons! All I say to the Wilsons:

"Robert Novak, some other commentators and the Administration continue to try to completely distort the role that Valerie Wilson played with respect to Ambassador Wilson’s trip to Niger. The facts are beyond dispute. The Office of the Vice President requested that the CIA investigate reports of alleged uranium purchases by Iraq from Niger. The CIA setup a meeting to respond to the Vice President’s inquiry. Another CIA official, not Valerie Wilson, suggested to Valerie Wilson’s supervisor that the Ambassador attend that meeting. That other CIA official made the recommendation because that official was familiar with the Ambassador’s vast experience in Niger and knew of a previous trip to Africa concerning uranium matters that had been undertaken by the Ambassador on behalf of the CIA in 1999. Valerie Wilson’s supervisor subsequently asked her to relay a request from him to the Ambassador that he would like the Ambassador to attend the meeting at the CIA. Valerie Wilson did not participate in the meeting.

As the CIA itself has officially confirmed, Valerie Wilson did not send Ambassador Wilson to Niger and she neither suggested him nor recommended him for the trip. Furthermore, the Ambassador agreed to travel to Niger pro bono with only his travel expenses being paid."

I have a question- could the suit result in some kind of gag order, to stop the endless spinning and lies about the Wilson's? I'd like to see the Rove spin machine with an oversized sock stuffed into it. The lies are more and more revolting to hear and to read. But I would think Rove and his posse would not be able to make comments (i.e. lie and spin) about the events leading to their being sued, even in a civil case. Just wondering...

Coors, 59, was driving a 2004 Jaguar when he was pulled over in Golden by a Colorado State Patrol trooper just before midnight on May 29, according to officials in the Jefferson County District Court clerk's office.
He faces charges of driving under influence after registering a blood-alcohol level above the legal limit

of .08 percent. He also was cited with failure to obey a traffic control device.

That was good news, she may finally have some closure...I was in senators offices ALL flippin' day-I should be paid just to educate them.
I am amazed at how much they don't know (legally) about a war they support. I turned a few of them on to a good booklet Law v. War -by the US Army War college, no less.

Have been very busy working and have not had a chance to read the posts re the Plame civil suit. Has anyone addressed the issue of the timing of the lawsuit?

Why now? Are there statute of limitations problems if they wait any longer? Has Fitz given Plame any indication that the filing of the civil suit will not impair his criminal investigation? Were Novak's recent public statements done because the Republicans knew the suit was coming and wanted to get Novak's statement out there first? Or are both events the result of Fitz informally advising both of them that he won't be pursuing his investigation further after Libby's prosecution is over?

Or is this a big feint by Fitz as part of his pursuit of others?

Inquiring minds want to know.

Has this ever been a week to make conspiracy theorists happy, or what? One set of thinking goes along the lines of "Ken Lay's death this week is somehow part of a war between political factions and that
former Secretary of State Colin Powell (who is rumored to have testified to one of the Fitzgerald grand juries) being rushed to the same hospital in Aspen Colorado where Lay
was brought and pronounced dead, is not entirely coincidental." While I'm curious what Powell was talking to Bill Clinton about at dinner (secrets for to help Hillary leverage her way into the White House, perhaps?) the real problems faced by us plebes is not necessarily the ins and outs of funny money rumors in high (pun intended) places, but how do we cope with the obvious problems. I mean besides the Chinese fielding nuclear subs now that are reportedly in the same league with our Ohio-class boomers (designed with some of that Clintonista supplied computer gear, I expect). Nope, we have even bigger problems than that! Rearview inflation and resource gleaning.

Hey, the day of the lawsuit press conference, July 14th, is the 3rd year anniversary of Novak's column (and Bastile Day). They need to sock it to them. Lawsuits are not always about winning but getting something to STOP. Until I hear otherwise, I think all that was about 'workplace' retaliation / revenge. The WH was hopping mad about Wilson's column and could not go after him directly, so they went after his wife instead, thinking they would not get caught. That is what spoiled brat / schoolyard bullies do when they grow up and get powerful jobs.

For those folks who think the outing was all about getting Plame off Iran, the outing was in 2003. Pres. Khatami was still president in 2003, not Ahmadinejad. If you think I am wrong about that, go do some homework on Khatami--he was not the same as his replacement. I certainly buy into the idea that those guys were furious about Wilson's column and wanted revenge. And, they were mad at the CIA for the Niger trip.

They are still mad at the CIA, which is why they keep messing with the CIA and putting the military guy in charge, instead of promoting one of them. These folks lose sight of what is good for the country but instead let their personal biases get in the way. They think about only what is good for themselves.

On another high-ranking person . . . Hastert has diabetes, and I bet Basheert can address how difficult it is for a diabetic to get rid of an infection.

Hastert's opponent is a kid. I do not know his actual age. He's a nice kid and certainly not corrupt, but he has very little experience. His campaign is run by other young people and angry union guys. John Laesch link I think the odds of winning the Illinois lottery might be better than this guy beating out Hastert. For Hastert to lose, there would have to be a lot more scandal and/or he would have to be really ill. I do not believe it is realistic to think that Hastert will lose in November unless something really drastic happens.

I do not know what will happen in Israel other than right now, that has the potential to be a complete bloodbath. There have been problems in the past and things settled down but I have a really bad feeling about this right now. If anyone has information on a chronology of when Israel started calling up its reserves in the past, that would be helpful.

Although I do not have independent confirmation, I heard the rumor from a well-placed source that Secretary of State Rice attempted to increase pressure on Israel to stand down and to demonstrate "restraint". The rumor is that she was told flatly by the Prime Minister's office to "back off".

Teak--that person writing about the stuff in Serbia was all over the place, probably due to ESL writing. The writing of the Katheryn Cramer, the blog owner, was a mess, too. So the information probably needs to be triangulated, checked against at least two other sources. I find that people who cannot write in an organized fashion often cannot think in an organized fashion either.

But, there were all kinds of nasty atrocities going on in the former Yugoslavia. Milosevich certainly belonged in jail at The Hague for war crimes, and is probably rotting away in hell.

Judge grants request to allow depositions
By Rick Klein, Globe Staff | July 14, 2006

WASHINGTON -- A New Hampshire judge yesterday cleared the way for Democrats to question top Republican Party officials -- including its former national committee chairman -- in connection with a 2002 phone-jamming scheme, as a local political scandal continues to reach into the realm of national politics.


Hillsborough County Superior Court Judge Philip Mangones granted the Democrats' request to allow depositions of Republican officials. Each subpoena would have to be granted on a case-by-case basis, however. If individual subpoenas are granted, officials will be forced to answer questions under oath about whether they were involved in the plan to tie up Democratic get-out-the-vote hot lines on Election Day 2002.

``We want to figure out the scope of the conspiracy," said Finis E. Williams III, an attorney for the New Hampshire Democratic Party. ``Was the White House involved in this? We'd like to know that. The Republicans have never to this day come forward and come clean and said who was involved in this and who wasn't."

Among those in question are Ed Gillespie, who was Republican National Committee chairman at the time of the incident; former RNC political director Terry Nelson, who is now a top adviser to Senator John McCain of Arizona; and Alicia Davis, who worked in the White House political affairs office under Ken Mehlman, the current RNC chairman.

Williams said the Democratic Party will seek to compel testimony from Gillespie, Nelson, Davis, and at least five other officials. He said the party may also try to depose Mehlman, depending on the testimony the others give. Democrats also want to force the White House to identify who spoke to New Hampshire Republican operatives in the days surrounding the election.

Through his ruling, the judge made subpoenas possible, but he did not include individual requests for specific depositions. An RNC lawyer, Robert Kelner, indicated yesterday in court that some of the subpoenas may be contested.

National GOP leaders, including Gillespie and Mehlman, have denied knowing about the scheme in advance and say Democrats are using the situation to score political points. Kelner said the RNC did not fight the efforts to allow subpoenas because party leaders have nothing to hide, though he said each individual will decide whether to testify.

``To my mind, this appears to be largely a political exercise aimed at an election-year audience," Kelner said.

According to court testimony, officials with the New Hampshire Republican Party hired a telemarketing company to tie up the hot lines Democrats and a local firefighters' union had set up to help get voters to the polls. The scheme was called off after less than 90 minutes, after state party officials questioned its legality.

The incident, however, led to the conviction of two Republican Party officials -- one associated with the state party and one with the national party -- as well as an executive of the company that conducted the automated phone calls.

The phone jamming occurred as voters chose between Representative John E. Sununu and Governor Jeanne Shaheen in one of the most closely watched Senate races in the country. Sununu won the race by about 20,000 votes, helping Republicans regain control of the Senate.

Democrats point to phone records that show that James Tobin, the national GOP official convicted in the scheme, had regular contact with the White House and the RNC during the three days in which the plan was finalized and carried out.

Tobin was the RNC's regional director for the Northeast during the 2002 elections, and the party has covered his legal bills, which have totaled more than $2 million. Tobin, who was sentenced in May to 10 months in prison, has appealed his conviction.

``Top Republican operatives will finally have to answer questions about their involvement in an illegal scandal aimed at stopping people from voting," said Michael Gehrke, executive director of the Senate Majority Project, a Democratic interest group that conducted the analysis of phone records.

The GOP depositions would become part of a civil lawsuit Democrats have filed against Republicans, seeking unspecified damages stemming from the jamming. The trial is to begin Nov. 27 -- meaning the pretrial depositions would occur in the months leading up to the congressional elections.

For the last time, George Ryan emptied out death row in Illinois AFTER he already knew he was in BIG TROUBLE. He never said anything about planning to do that until after he was in trouble. It was all a big publicity stunt. The 'journalists' at WMR really need to go do some homework, starting with the work of Fitz in New York. After WMR masters basic research, then those folks can move on to more tricky stuff. Sure, finding corrupt officials in Illinois is easy, but, getting a conviction against them is difficult. A good journalist would go look at why getting a conviction in Illinois is difficult. A good journalist would go look at who and why Fitz was brought to Illinois.

Dean says that he knew that the Wilson would pursue a civil suit with defamation of character and violating their civil rights. But, more importantly, Dean pointed out that the Wilsons' 23 pages lawsuit(and I read the 23 page) make references to the Fitzgerld's current filings and court documents on the leak case (U.S. vs. Libby Cr. No. 05-394 (RBW)). In other words, this civil suit goes also more beyond just asking for money. The Wilsons are really want answers from the Administration of their conduct. but, it leaves the public also wanted answers too. Dean said that the civil suit is brought under the rule of the Bivens vs. Unknown Names Agents of Federal Bureau of Narcotics (a 1971 case). that case included statutory civil rights. this case is mentioned in Wilsons' lawsuit. Dean did say that the Wilson will win this case. but this case put the smurf in a pickle since he is currently preparing for his criminal case with the goverment and now have to prepare for a civil lawsuit against the Wilsons.

The Wilsons and their attorneys were very clever by filing this lawsuit now. They waited patiently. And they will give Mr. Novak a bottle of champaigne when this over because Novak help the Wilsons to file their lawsuit unwittingly. When cocky Novak came forward with his Danielle Steel's version of his story and he named Rove as one of his sources in writing and in public, that sealed the Wilsons to move forward with their lawsuit. That it what was needed as proof that Rove was involved in the leak case and he was one of the sources for one of the reporters. And it happened to be Novak! Olbermann asked Dean why wasn't Novak is in the Wilson's lawsuit (And I know that alot of you bloggers wanted Novak in that civil suit filing). Dean said that Novak is a separate lawsuit from the Wilson's lawsuit against Rove, Libby, and Cheney. I think that thatit was smart of the Wilsons to focus on those key players who are directly involved in the leak case and discrediting the Wilsons. I wouldn't rule out the Wilsons pursing Novak in a lawsuit. That is up to them. They are going after the big guns first.

As far as the little soldier and the new pickle that he is in, Matalin has to throw a hell of a lot of KFC chicken dinners to pay his share of his civil suit! If Libby doesn't have the loose charge to pay his substantial legal fees for his criminal and civil case, his attorneys, Cline, Jeffress, and Wells will sue Libby for their fees as well as his civil attorneys. The smurf is the only one out of the group with no resources!

Report: Harris tried to implicate Scarborough in intern's death

Katherine Harris' downward slide began with a phone campaign to implicate Joe Scarborough in the 2001 death of an intern, according to insiders quoted in a report in today's Miami Herald.

Excerpts from the Herald story follow:

...It was Joe Scarborough, host of the prime-time MSNBC show Scarborough Country and a former Pensacola Republican congressman who was courted last summer by national Republicans to run against Harris. But before he could announce he wouldn't, Harris called major donors and suggested Scarborough would have to answer questions about the strange death of a former staff member in 2001, according to two former high-level Harris staff members, a GOP donor and Scarborough.

''That was the first clue that something wasn't right with Katherine Harris,'' Scarborough told The Miami Herald in a recent interview, noting that a medical examiner found his staff member's death was natural and not the result of foul play.

Harris, through a spokeswoman, denied Scarborough's account, saying she ''would never insinuate publicly or privately'' that he did anything untoward.

But her former staff members say they expected her to deny the previously untold anecdote, which they say marked the beginning of the Harris campaign's tailspin. Since then, Harris has been dogged by her connections to an indicted defense contractor and by heavy staff turnover from last fall through Thursday, when five top aides announced their departure a day after her spokesman quit. Her campaign had issued a news release Wednesday suggesting only spokesman Chris Ingram was leaving.
