Abramoff and 4 Others Sued by Tribe Over Casino Closing

HOUSTON, July 12 — An Indian tribe sued the former superlobbyist Jack Abramoff and Ralph Reed, a candidate for lieutenant governor in Georgia, on Wednesday, seeking millions of dollars in lost revenues from a casino that the Texas tribe said had been fraudulently closed.

The suit, in Federal District Court in Austin, says Mr. Abramoff, Mr. Reed and three other men mounted a fake religiously themed moral crusade in 2001 to defeat a bill in the Texas Legislature that would have legalized gambling in Indian casinos.

Their real motive, the suit adds, was to promote the gambling interests of a tribe in Louisiana that was paying them to represent its interest in a competing casino.

Two former Congressional aides who pleaded guilty to corruption charges along with Mr. Abramoff were also named in the suit: Michael Scanlon, who worked for the former House majority leader Tom DeLay of Texas; and Neil Volz, formerly on the staff of Representative Bob Ney of Ohio.

Jon Van Horne, who worked with Mr. Abramoff at his lobbying firm in Washington, was also named.

“This case chronicles Jack Abramoff and his associates’ greed, corruption and deceit and their devastating impact on Texas’s oldest recognized Indian tribe,” said the suit, filed by the Alabama-Coushatta Tribe of Texas.

The tribe, whose 4,594-acre reservation is 75 miles northeast of here, was forced to close its sole casino in 2002 by a federal court order. Lawyers for the tribe said the closing had devastating economic effects on the community, including the loss of several hundred jobs.

Mr. Reed, who faces a Republican primary in Georgia on Tuesday, has previously denied ever working on behalf of a casino or accepting money from a casino company, saying all of his actions were aimed at stalling the spread of gambling.

A spokeswoman for Mr. Reed, Lisa Baron, said the suit was without merit. “The illegal casino violated Texas and federal law and was ordered closed by a federal judge,” Ms. Baron said. “As a longtime opponent of casino gambling, Ralph was happy to work with Texas pro-family citizens to close it.”

Mr. Abramoff declined to comment, said a spokesman, Andrew Blum.

The Louisiana-Coushatta tribe, Mr. Abramoff and Mr. Scanlon’s original clients, sued the two in November 2004, accusing them of overcharging for work never done.

Fred Petti, a lawyer in Phoenix for the Texas tribe, said the tribe wanted compensation for all its lost gambling revenues since the casino closing. The figure, Mr. Petti said, would certainly run “in the tens of millions of dollars, and perhaps into the hundreds of millions of dollars.”

Mr. Abramoff became one of the most powerful and connected lobbyists before a corruption scandal involving free trips and other gifts for elected officials led to his guilty pleas in January and a promise to cooperate with investigators.

Mr. Reed, whose ties with Mr. Abramoff have become a thorny issue in his campaign, was executive director of the Christian Coalition in the 1990’s and started his consulting firm, Campaign Strategies, before making this run for office.

Beyond the Alabama-Coushatta casino, the suit says, the defendants conspired to pit tribes against one another, defrauding one at the behest of another before trying to persuade the victim to hire them to retaliate.

Cedar Rapids Newspaper Drops Ann Coulter's Column

NEW YORK Ann Coulter is no stranger to controversy, but her latest adventures have several newspapers questioning whether carrying her syndicated column is worth the trouble. The Shreveport (La.) Times is currently leaving the decision of whether or not to keep Coulter up to its readers. But the first newspaper to officially drop Coulter’s column since the latest uproar began seems to be The Gazette of Cedar Rapids, Iowa, where she had appeared for about 14 months.

Opinion Page Editor Doug Neumann told E&P, “Our decision was made before the plagiarism allegations. It did come after the publication of [Coulter’s] book, but I would say it didn’t directly play any role on our decision.”

However, Neumann surmised that Coulter’s incendiary book may have played an “indirect” role in the final decision. “I think it was the book that began to unwind support among her readers,” Neumann explained.
“Liberals have never liked her, and we’ve always gotten complaints [from them]. But the complaints that mattered the most were from the conservative readers,” who felt that their views were being misrepresented.

Coulter's syndicate, Universal Press, cleared her of plagiarism charges earlier this week.

Though The Gazette may be the first to drop the outspoken conservative columnist in recent months, Neumann emphasized, “It’s not uncommon for opinion pages to change their line-up." The daily has long published conservative Cal Thomas and replaced Coulter with another conservative, David Limbaugh.

“We’ve always had a rich line-up of conservative columnists,” said Neumann, “and we still do.”

Feds: Salad dressing should have been tossed

Showing he will leave no leaf unturned in battling crime, U.S. Attorney Patrick Fitzgerald poured on the latest: corrupt salad dressing.

His office on Wednesday charged two men with selling salad dressing so old it should have been tossed.

Ross Marks, 39, of Glencoe, and Charles Farinella, 45, of Woodridge, illegally relabeled 1.6 million bottles of salad dressing to say they expired a year after they really did, according to charges.

Sold for $546,000



They postdated labels on eight- and 16-ounce bottles of assorted varieties of Henri's salad dressing and sold them for about $546,000 to stores locally and nationally, prosecutors say.

The salad dressing scandal is no laughing matter, prosecutors say.

"No, of course not," said Assistant U.S. Attorney Juliet Sorensen, who noted the men put consumers at risk and were charged with serious crimes, including wire fraud, product tampering and violating a federal statute for misbranding consumer food products.

'Sell by' dates changed



All of the bottles, manufactured by ACH Food Companies Inc. in Memphis, were originally labeled with 2003 sale dates and changed to 2004 dates. Marks, who was president of the now-defunct Division Sales U.S., LLC, in Des Plaines, allegedly typed up a false letter indicating to a relabeling company that ACH had approved the new dates.

In 2004, Farinella told an ACH food representative that the Food and Drug Administration approved it, according to charges.

Attorneys for the men could not be reached for comment.

Anyone with bottles of these salad dressings should call the FDA at (800) 521-5782.

Through a spokesman, Fitzgerald refused to comment on his favorite type of salad dressing.

Complaints by a couple of Good Ol’ Boys to legislation has never stopped the GOP leadership from rolling over dissenters.

This is a strategic stall — meant to de-criminalize the Republican Party’s new game of challenging voters of color by the hundreds of thousands.

In the 2004 Presidential race, the GOP ran a massive multi-state, multi-million-dollar operation to challenge the legitimacy of Black, Hispanic and Native-American voters. The methods used broke the law — the Voting Rights Act. And while the Bush Administration’s Civil Rights Division grinned and looked the other way, civil rights lawyers are circling, preparing to sue to stop the violations of the Act before the 2008 race.

Therefore, Republicans have promised to no longer break the law — not by going legit… but by eliminating the law.

The Act was passed in 1965 after the Ku Klux Klan and other upright citizens found they could use procedural tricks — “literacy tests,” poll taxes and more — to block citizens of color from casting ballots."

I was waiting for this: a reaction from Joe Wilson regarding Novakoholic's article. Way to go Mr. Wilson. From Raw Story:

As to the current wars. What was the world like before George W. Bush.
20 world leaders talking together, Bush steals the election to represent the US. He goes in with war on his mine, starts stirring up trouble and change, brake laws and steals. Others say if he can do that so can we. Results today all countries are in chaos because on so called leader started it all.
Israel says it has the right to protect their country, North Korea, Iran don't. US test missiles but North Korea can't. Bush decides who has nuclear power not the UN. The current United States President started hatred, greed and lying for all others to follow. MY house is a CAVE!! It gives the illusion of "cool" ... the good news is that all the utilities are running at 100% including Palo Verde and all the small generating stations locally as well.

Hang in there .. we broke a record yesterday, expected to peak record usage again today. We have this nifty little device internally that allows us to monitor hourly MegaWatt energy usage.

I need to resked lunch with you - I ended up having an appt tomorrow I hadn't planned on. We definitely will get together though - next week or the following (Fri or Mon) would work?

In truth, two major news outlets confirmed the National Journal story the same day it was published, May 25.

Here's MSNBC confirming Waas' story:

[S]ources close to [Karl Rove] are now confirming a story first reported in the National Journal that Rove, who was a source for columnist Bob Novak, later had a separate conversation with Novak after the investigation began.
Former federal prosecutors are convinced Fitzgerald has explored whether Rove and Novak coordinated their testimony.


And here's Bloomberg confirming Waas' story with its own sources, on the same day:

Syndicated columnist Robert Novak assured presidential adviser Karl Rove that he wouldn't identify him to prosecutors investigating the disclosure of a CIA agent's name, a person familiar with the matter said.
Rove told a grand jury that Novak called him shortly after the Central Intelligence Agency asked the Justice Department to investigate who leaked the name of operative Valerie Plame to Novak and other reporters, the person, who spoke on the condition of anonymity, said. Novak revealed Plame's name in a July 14, 2003, column, citing unnamed administration officials.
The National Journal, which reported earlier today on the Sept. 29, 2003, conversation between Rove and Novak, said Justice Department prosecutors were concerned that Rove and Novak may have been working on a cover story to protect Rove.
The story is particularly damaging to Novak because it raised concerns that Novak and Rove coordinated their grand jury testimony, even possibly developing a "cover story" for themselves. At the very least, the conversation was inadvisable and unethical -- and, if a false story was concocted, against the law.

There were conflicting accounts yesterday about Mr Coulbeck's reaction to being drawn into the US investigation and the way he was treated. Sources familiar with the US investigation, as well as the NatWest Three's London lawyer, Mark Spragg, said Mr Coulbeck was a peripheral figure in the fraud case.
It is understood the FBI last interviewed Mr Coulbeck in 2002, and he signed a witness statement in November 2003. The three are accused of an £11m fraud in which their former employer, NatWest, was advised to sell part of LJM SwapSub, a company owned by collapsed US giant Enron, for less than it was worth.
Mr Coulbeck's statement was a three-paragraph explanation of his role at RBS and at NatWest before the Scottish bank took it over in 2000. Mr Coulbeck had worked at Natwest and RBS since 1983 and worked at the Greenwich NatWest subsidiary in the US between 1998 and 2000.
As a managing director in charge of balance sheet management, he had responsibility for making sure the company had sufficient financial resources for its operations.
But he claimed to have no knowledge of the final stages of the transaction which lies at the heart of the alleged fraud.
A spokesman for RBS said: "There is no evidence that Neil was involved in the approval of the sale of the transaction under investigation."

Neighbour Oonagh de Berry, 37, said Mr Coulbeck was an "unassuming and shy" man who regularly jogged in nearby parks. "Only a few days ago they had a marquee in the garden and some kind of big party. They seemed like a normal happy couple."

Your Boss just came to visit the German town of Stralsund.

In preparation the hole town center had been sealed off and only 1000 specially selected and invited citizen (400 less than invited acutally turned up) where permitted to enter to pose as some sort of supporting flag waving "Welcome Dear Mr. President" display...

Some thousand protestors had gathered outside the town as they were prohibited to enter or even pass through the town..

Now folks that's a farce and it's sickening as hell...so much about free speech...

Um just listen to the spin/twist/lie/secrets as Novak, Rove and supports talk away. While Fitz listens and up dates the facts for the up coming trial. It is a shame that Germany has to do propaganda for the Gerbil. We have to endure the Gerbil's propaganda here. The word here is that the Gerbil is cutting back on his August vacation and hitting the states..(we will see if that is true) He might have been scared to go back to Crawford Rach. Let's see who gets called in to testify. I hope Tweety, Brooks, Miller, Cooper and others get their day in court. Your so right SPB the rules are different in a civil case then a criminal the burden of proof is less. Cheney will have to lose some of that stolen money he got from the US Treasury and Halliburton. Faith is a wonderful thing just have faith in God while Bush aka Satan is working his evil.

Since I mentioned O.J. Simpson:

On February 4, 1997, a civil jury in Santa Monica, California found Simpson liable for the wrongful death of Ronald Goldman, battery against Ronald Goldman, and battery against Nicole Brown. Attorney for plaintiff Fred Goldman (father of Ronald Goldman) was Daniel Petrocelli. Simpson was ordered to pay $33,500,000 in damages. However, California law protects pensions from being used to satisfy judgments, so Simpson was able to continue much of his lifestyle based on his NFL pension

BTW, Petrocelli was the attorney for Lay and Skilling in the Enron case. And you know what happen in that case. I don't think the stature of limitations have ran out for the Wilson's lawsuit. Joe Wilson did say week ago that he and his wife will weight on if they going sue. I think that Novak's article and on the talk show circuit made the Wilsons have enough. But, we will see on Friday what exactly the lawsuit entails, the charges, and the amount that they are seeking... I think this should be a topic of discussion for Fitz to post on Friday after the Wilsons release their statement. In the meantime, I will hold my opinion until after hearing the Wilsons' statement!

As Jackie said: the civil lawsuit against the Wilsons is separate from the current CIA Leak case and Libby case. But, with the Wilsons' lawsuit, no amount of money (no matter if they use the entire drawers off those bastards)will ever replace the pain that the WH has caused on that family and the years of service that Ms. Wilson has given to the CIA! And I mean ever!
