Fitzgerald said he does not have to prove that the disclosure damaged national security to secure a conviction of Libby for perjury, false statements and obstruction of justice.

Here's my question regarding the above: Why not get that CIA damage assessment? From what I have heard (of course I have no way of knowing for sure) and from analyses of news and known info-MAJOR damage was done.

So why not use it? Or maybe you are using it for leverage? WHEN, WHEN?

How many laws do they need to break?
100? 105? Geez! People are tired of waiting for the law or some rich guy to step in and save the US.

Maybe someone should call in the Calvery to save the Union? Or do we have a better chance calling Batman, Superman, Spiderman?

Switching gears. Interesting news:

1. U.S. Ambassador, "Anger Management, John Bolton is heeding a call to want Kofi Annan replaced. And this is a man who nomination last year was not approved by the Senate.

2. Condi Rice says that Hugo Chavez is the biggest dangers to Latin America. Now, he is the axis of evil. This is that same Chavez who stood side by side with Cindy Sheehan in Venezuela and told her that he wants to join her protest in Texas.

Finally, from the Boston Globe newspaper, the connection between DeLay and the Bush Administration and oil profits. Sounds like the a page from out of the movie "Syrianna."

WASHINGTON -- When Tom DeLay was the most powerful man in the House of Representatives, Congress and the president devoted $500 million over 10 years for an oil and gas project lawmakers expected to go to a firm in DeLay's hometown.

But just a month after the embattled former House majority leader announced he would not try to keep his leadership job, the Bush administration cut funding for the project from its 2007 budget, and announced in the fine print of its 1,220-page fiscal blueprint that it would seek legislation to kill the program outright.

A Department of Energy spokesman said the decision this month merely reflects President Bush's desire to weed out ineffective programs. But in political circles, lawmakers and analysts saw the cut as a slap against a man who no longer has the political muscle to hit back.

Fitz I've been waiting for you. Now I read all the stuff and your in charge of this one. But I have been thinking ( yes again ) Has any of your staff found a standing case to show cause? I know the press is limited on brains but has case law shown a previous case that still stands with this example. I was so proud on the slam dunk you made it made me believe in the law again. How in the world do you do that origami thing I tried and my fingers hurt so I had to take a aspirin for pain. It was a good day to see the little angel kick butt.

While Fitzgerald's brief isn't filled with quite as many clues and nuggets as other recent court filings, the prosecutor says there's a reason he's being circumspect. Additional details about the case are contained in a separate filing made under seal, he says, because releasing them now would reveal the "strategy or direction of the investigation," which he says is -- hello, Mr. Rove! -- "continuing."

Now this is interesting on Raw Story. A blogger named Michael Petrelis has requested from the FBI to turn off information about Cheney. FBI located about 780 pages about Cheney and, for two years, nothing has been released about Cheney. Mr. Petrelis was willing to pay for the pages but he still hasn't recieved not even a single page from the FBI. But, he received 20 pages on Bush in April 2005. And Bush did received threats from mail. Here is the information:

I'm a little depressed about this whole situation now. I'm afraid that Libby won't go to trial until late 2007 (due to adjournments, etc.) and then when he is finally convicted (which I'm convinced will happen), Bush will just pardon him. The guilty parties in this case seem to be getting off. I just hope someone is held accountable. Anyone have anything to cheer me up?

I know that things look grim. But, cheer up, things will be on the up and up. I have been keeping up with the Enron Trial. The news don't bother cover it since there is so much going with other scandal. But, I read this on WSJ law blog about a piece from the trial that is amusing. This certainly will not be on the news. This was dated 2/16/06. BTW, a week ago, someone attending the jury trial actually asleep and was lending her head against the wall while sitting:

"Last week Skilling lawyer Daniel Petrocelli was asked by a juror to wash off his cologne because the juror was bothered by it. There was apparently some confusion over what brand of cologne Petrocelli was sporting. According to the Houston Chronicle trial blog, the cologne was Tabacco by i Profumi di Firenze. This fragrance’s Web site includes this description of Petrocelli’s scent:

Did you really say that in court? I know you were quoting the Evil One, but I think he meant crown jewels, not family jewels. "Crown jewels," used as an idiom, means a prized possession or asset. Whereas, "family jewels," although a prized possession and possible asset to the owner, means something else entirely.

Although given the veep's cowardly actions over the last week, I certainly understand how he might not know the difference, because he obviously doesn't possess the latter. On the other Fitzy, we have no such doubts about you.

Very interesting link you gave. The comments are almost all anti-Fitz, and offer negative critiques of your filing. Many of them seem to be hung up on the claim of materiality, and your intepretation of statues.

I have a feeling they are looking at the case on a very two-dimensional level, rather than as a three dimensional situation in which check and mate can come from a most unexpected direction.

Well, I can hope, anyway, right?
