Neither Snow, Nor . . . Will Stop Patrick Fitzgerald From Appealing His Case

While Manhattan’s federal trial court was closed yesterday to honor Abraham Lincoln (see yesterday’s post), just down the street the U.S. Court of Appeals for the Second Circuit heard Patrick Fitzgerald’s special assistant James Fleissner argue that his office was entitled to access the phone records of two New York Times reporters as part of the CIA leak investigation.
The New York Times’s Adam Liptak reports that the appellate judges seemed sympathetic to the trial court’s decision, in which Judge Robert Sweet ruled for the newspaper on First Amendment grounds. One judge asked Fleissner a hypothetical question about “All the President’s Men” and whether the government would be entitled to a video of Woodward’s garage rendezvous with Deep Throat, had one existed. Fleissner reportedly said that Woodward would have no legal protection if a grand jury investigating the unlawful disclosure of information sought a videotape of his meeting with Deep Throat. “That garage video would be in play,” Mr. Fleissner reportedly said.
Apparently the most interesting development came outside the courtroom when Fitzgerald greeted Judith Miller, the New York Times reporter who served 85 days in prison for contempt of court before agreeing to testify in the case.

the patterns there don't change they just shapeshift around to fit those in power..
