Free speech ends when the employer's clock starts ticking and afterwards, too. Do I use my real name here? No way! At some point, I may decide to get a better job. Even potential employers now 'Google' job applicants names to find out what is out there, whether is accurate or not. (BTW, there are at least two more Patrick J. Fitzgeralds out there, one writes books for children and the other is an expert on pancreatic cancer). :-)

Also, the government, companies, etc. own the e-mail accounts, the computers, telecommunications lines, etc. The CIA computer expert wrote about bad cafeteria food, what if someone was tying up the routers and hogging bandwidth, slowing down everyone connected to the network by downloading huge music and video files that were not job-related? Wow, that was so not smart to poke fun about the Geneva Conventions using the CIA's own computer equipment.

I know this lady is toast. I think she can probably forget about suing for wrongful termination, but I am not a lawyer.

Hackett apologizes to, supports Brown

Hackett's conversion came last week. He decided it was pointless to continue the political feud left over from his short-lived primary campaign against Brown, a feud that could have been helping Republican Sen. Mike DeWine's efforts to stay in office.

"This is my evolution as a hot-headed Irishman," Hackett said. "Look, let's get over this."

DeWine also ran smear ads against astronaut John Glenn. I wanna file a complaint against DeWine for trying to weasel dubya's way out of FISA..it's gotta be unethical.

In regards to this post...

I think it's wrong that they terminated her...

but not surprising considering the climate in the government these days...

However, as a software engineer, she SHOULD know that she is using "company" equipment on "company" time to blog...and she SHOULD know the laws...

I am constantly telling people I work with or that I consult with that they should not use business computers for private use...and to not use their company email account for private use...I have been an email & web server administrator, network admin, etc...nothing is private at a business...

Now some businesses are lax in their policies or do not have it in writing...however -- if an employer one day wants to get rid of you...all they have to do is dig up the goods from your email or internet surfing history...sieze your work computer and do forensics on the hard drive of your workstation or laptop...and legally you are toast and out of a job...

so beware fellow bloggers that anything you do at work can be used against you at another time...especially if managers change or politics.

Personally, I wonder how people can have time to blog on their jobs but if this woman did blog while working for the CIA and they knew about it and seemed ok with it, they should have set boundries for her blogging. It is okay to blog until we say something the employer doesn't like?

I'm curious, does the CIA people try out the torture techniques on each other first to see if they work or counter-act if they were captured? Have they done studies to see if torture creates more terrorists? Anyone?

chimpcoulter, I think you will see that from many "red-state" citizens, probably why it was kept secret. Disgusting.

In some places..I wonder if whole small towns will be wiped off the map? Another thing for the city-slickers, in some states you might have to travel 20 or so miles to get groceries since the small town grocery store can no longer make it. (thanks, Wal-Mart) Huge gas prices and tolls to get food that no doubt will rise in price also...but hey! Rep. Jim Ryun says the minumum wage doesn't need raised nor do we need paper trail voting systems. And yes, he responds so polite to my emails about these issues. Brownback and Roberts quit replying at all.

Good-bye small family farms, small towns to raise good kids, good-bye America. We really do live in the Land of Oz.

Negroponte blocks analysis of Iraq civil war

Director of National Intelligence John Negroponte is preventing a thorough examination by intelligence analysts of the civil war in Iraq, RAW STORY has learned.

A report at Washington Babylon, the blog of Harper's Magazine's Washington Editor Ken Silverstein, indicates that Iraq analysts at the CIA have been pushing to complete a National Intelligence Estimate (NIE) on the political situation in the country. NIE's are the most authoritative intelligence documents produced by the CIA, and the last NIE on Iraq was rejected by the Bush administration for being too negative.

But since the calls to analyze the Iraq conflict have emerged, Silverstein reports, Negroponte has tamped them down. One of Silverstein's sources explained that Negroponte didn't want President George W. Bush to be confronted with a pessimistic assessment of the war in Iraq.

And it really P!sses me off when you write letters to Senators and Reps. -- and you get those obnoxious form letters back saying they are voting the other way...

I can't stand our 2 Senators here. But I think Talent may be beatable this time...I'm sending money and support to his challenger (but he has raised double her funds)...

I have blogs for non-profit groups that I do stuff for but there is no NightOwl blog. And yes, the non-profit stuff is not done at work. (!)

I am not on work hours right now.

And, for the record, I really love the cafeteria food at the American Embassy.

Had I been the computer lady's boss, I would have told her to make the stuff go away and given her a warning first. Geez, they should have seen the bad press coming on that story, like the CIA needed more bad press. . . Duh!

I get actually very little sleep. If there was a NightOwl blog, it would be all about various caffinated beverages. ;-)

I noticed that Israel is calling all reserved troops and most are Americans. One blog site documented that few Jewish people are fighting in Iraq/Afgan but signing up in Israel war. American/muslins are fighting with the US. That says alot. Connie Rice is going to the Middle East and I think it's a waste of time. She is only the messager for Cheney not like Mr. Powell who was a real Secretary of State until he lied to the UN.
As for Tony Snow and his lack of clearence. Snow just wanted to be in there with the crooks he's getting his propaganda money. All this talk about national securtiy as the WH has a Press Secretary who is around all the secrets but no clearence. Homeland Security is a joke.

Not only is one overdue, but there's also a fear that if the Democrats win control of at least one chamber of Congress this November, the agency is going to get hammered for not having produced an NIE for so long.

When the topic of a new NIE was first raised, the Directorate of National Intelligence agreed to consider the matter, but advocates heard nothing back. They raised the topic again several months ago and were told that Negroponte was still mulling over the matter. Since then, there's been no indication that the DNI intends to authorize a new NIE. “He's not going to allow [analysts] to call the situation warts and all,” said one source. “There's real angst about it inside.”

"Today, July 20, 2006 has been a very interesting day. I went to see the President of the United States and Jesus Christ redirected my path. The All Mighty Father had other plans for me instead.That new path is positive and full of surprises.


The last time something like today happened and completely changed America and mankind was thirty-seven years ago.
That was the day Neil A. Armstrong took the "Small Step" into our greater future when he stepped off the Lunar Module, named "Eagle," onto the surface of the Moon, from which he could look up and see Earth in the heavens as no one had done before him.

Well, today the heavens are being seen on the steps of the Rayburn Building and in Room 2426. You see, I handed over to that office a specialized set of print screens regarding Clint Curtis, Choice Point and Carlos Ledher and the election coup of 2000. The articles and evidence I gave freely to the Congressman's office.

I had a very interesting morning with an agency that shall remain nameless. An agency that came to my rescue this morning, a rescue that will save the word,"truth". These men and women who I had the privilege to meet have a job that doesn't get enough praise and definitely not enough money for their services.I will be going over this information plus other written materials regarding the manipulation and fraud of our elections dating back to my eyewitness accounts of evidence from 1996 through 2004.

The surprise of the day is that I had written an email on June 28, 2006 and today it will become a key piece of new evidence against Jack Abramhoff. What is so interesting it involves Bruce Cutler , John Gotti and Phil Spector's attorney. Gotti is guilty and Spector is innocent , yet Cutler only cares about the money and limelight, not justice, compassion or a man's innocence.The email also incorporates The Seed and Growing Together which is what got me physicaly involved with Bay Point School.



It involves a death threat on me and one of the protected twenty-two. It involves the restaurant "Bobby Van's Steakhouse" Its just interesting that I walk by their Washington D.C. restaurant almost every day. Every day since I arrived in the District of Columbia, which was July 5th 2006 from the City of Angels, Los Angeles via Amtrack.

How many times do I have to repeat that if you all want to do something (or stop the U.S. from doing something stupid), you have to contact your reps. in D.C. Use the House and Senate Web sites and do it electronically or by phone because the snail mail in D.C. is extra slow.

As far as WMR goes, that picture does not show direct evidence of gas being used in Lebanon. It shows a picture of someone holding a weapon. He is dressed pretty casually for someone who is supposed to be in the middle of a war zone. What's up with that? Hmmm?

And if the Gerbil and company have some type of tight noose around Fitz, why is that the Gerbil and company have diarrhea in the pants every time Fitz's name in mentioned? It just common sense folks. Its hard to see, but if you blow up that screenshot it looks pretty clearly like its a chemical weapons canister.

I'm PRETTY sure that the Israelis would not be holding a canister that has those letterings on the side, unless it was a chemical or biological weapon.

Who knows though, it could be some kind of water cannister or simply storage device. Or it could be a regular explosive, it just doesn't appear that way in the blown up photo.

Bill Kristol and colleagues have taken credit for starting the Iraq War but complain of a failure to move aggressively enough. On FOX Tuesday Kristol said, "we have to be ready to use military force against Iran."

But the president has his backers among some politicians and pundits. According to The Washington Post::

"GOP lawmakers, meanwhile, appear to be lining up closely with the president on foreign policy. It has not helped the neo conservative case, perhaps, that the occupation of Iraq has not gone as smoothly as some had predicted.

Some prominent conservatives, including William F. Buckley Jr. and George Will, have been sceptical of the mission in Iraq and, in Will's case, much of the ability of America to build democracy abroad. In his syndicated column yesterday, Will referred to the neo conservative complaints in observing that the administration is "suddenly receiving some criticism so untethered from reality as to defy caricature."

The charges resulted from a multi-million dollar LAWSUIT and SEC investigation, proving that lawsuits do result in indictments!

"U.S. authorities on Thursday charged former officers of technology group Brocade Communications Systems Inc. (BRCD) with fraud in the first court actions to result from an investigation of corporate stock option grants that has spread to 80 companies.

Federal prosecutors and the FBI filed criminal securities fraud charges against Brocade's former chief executive, Gregory Reyes, and its former human resources vice president, Stephanie Jensen.

The Securities and Exchange Commission filed related civil charges against both Reyes, 43, and Jensen, as well as Brocade's former chief financial officer, Antonio Canova.

From 2000 to 2004, authorities alleged, Brocade hid millions of dollars in expenses from investors and overstated its income by falsifying employee stock option grant records.

"By falsifying and backdating option paperwork, Reyes and Jensen knew investors would be given a false portrait of Brocade's financial condition," said SEC Enforcement Director Linda Thomsen at a news conference in San Francisco.

"Canova contributed to this false portrait by continuing to certify Brocade's false filings even after learning option paperwork had been forged," Thomsen said.

The SEC said it is investigating 80 companies. "This case will not be the last," Thomsen said.

Authorities are trying to determine if companies manipulated the grant dates of stock options to boost the profits available to corporate executives who got them.

Richard Marmaro, defense attorney for Reyes, said that his client was innocent. "If the government wants to make an example of an executive abusing stock option grants, it is choosing the wrong person," Marmaro said.

Attorneys for Jensen, 48, and Canova, 44, could not immediately be reached for comment.

No charges were brought against Brocade, a San Jose-based company that makes hardware for computer networking storage. Its shares closed down 11 cents at $5.91 each in broadly lower Nasdaq trading.

The company said that no executives involved in its past option granting practices remain employed at the company. It said it restated past results twice in 2005 after an internal inquiry.

In the 2006 first quarter, the company said, it reserved $7 million for a proposed SEC settlement. "Brocade continues to cooperate," it said.

STRAIGHT TO THE CEO

Jacob Frenkel, attorney at the law firm of Shulman Rogers Gandal Pordy & Ecker in Rockville, Maryland, said the fact that the Brocade case went straight to the CEO rather than starting with junior officers suggests authorities are moving quickly.

"We're not going to see the ladder-climbing that we've seen" in other cases, Frenkel said. "We're likely to see a lot of cases in a short period of time and a rapid clean-up."

The multi-agency investigation of corporate stock option practices is the latest scandal to hit corporate America and centers on two main patterns of potential misconduct.

A stock option is a contract giving the holder the right to buy shares of stock at a fixed strike price in the future.

The strike price is normally set as the market price of the underlying shares on the date the option is granted. Options granted this way are said to be "at the money."

In one practice known as backdating, option grant dates were retroactively set to precede a rally in the underlying shares, putting the options "in the money" and locking in risk-free profits for their recipients."

Roger, I did not deny that it was a chemical weapon. I am questioning whether or not the thing actually got blasted off into Lebanon! That picture could be from something else and stuck in there to make people think there Israel was shooting off chemical weapons. I really question that picture because those dudes look like they are off for a Sunday picnic (except for the heavy equipment) and they are not dressed for a serious battle.

Let's take a made up example. Say a reporter wants to make up garbage. This hypothetical unreliable (lying) reporter could take a picture from something else, like from a training manual, etc. and say, Look here! They are shooting off weapons at another country when no weapons were shot off at all, it was just a picture from training.

This skepticism of mine comes from having a communications/journalism buddy in college. It was way too much fun to take garbage news and pick it apart. For some assignments, the prof would hand out books and say, part of this is BS, find out which parts are BS and what is not, how is it BS, and prove that it is BS. If more teachers taught that way, we would have fewer people in the U.S. falling for propanganda, no matter the source, be it WMR or the WH.

Denying there is a problem with global warming and not doing anything about it... will not make it go away! The oil refineries, the big manufacturing plants, etc. all need to make the necessary changes. However, our ozone layer has been so depleted over the years...it will take drastic changes immediately!

Now you understand I why I was pissed of at Snowjob from my comment that I posted. It is bad enough that he doesn't qualify for the WH press secretary job but to have him roaming around the WH without a security clearance card and dictating to the press. One reason that it pissed me off is that I know people who worked for the government (before the Gerbil crwaled in to the WH) that had to go through the pain stakes of getting a secretary clearance card. And the American people are being double taxed for sales tax and 9/11 travel fees for the name of terrorism and we have dimwit walking around this earth with no means of support in a job with no security clearance card! Yes, I am sure that Snowjob didn't take a drug test. They would probably find an olive in the cup if giving that test!

The CIA computer blogger lady firing is not the same as Wilson-Plame. I do not have all night to explain the differences. The Cliffe Notes version is the CIA computer blogger was caught goofing off at work on the CIA's equipment which is not even close to the Plame - Wilson thing.

I do have excellent quotes from the July 24th, Time Magazine, article entitled "The Iran Factor" by Joe Klein, p. 31:

Yesterday, I asked Fitzgerald spokesman Randall Samborn if there were any guilty pleas in the case. He told me there was no "public record" of such pleas. That sounded less than fully responsive, so I asked Preston Burton, a white collar criminal defense attorney, if there could be guilty pleas outside of the public record. Here's what he said:


Guilty pleas can be taken under seal--and often are--when the person entering
the plea is cooperating with the government and they do not want to tip off the
other targets or there is a safety concern. Also, plea agreements could have
already been reached but not formally entered in court.


Considering Samborn's cagey answer and the fact that we know Fitzgerald received high-level cooperation from several current and former administration officials, it is entirely possible that Libby is not the only Bushie who's been busted.

Another substantive answer given by Samborn back on October 28, 2006 was directed to the question of whether the investigation was ongoing to which ">Samborn responded, “the investigation will continue with a new grand jury.”

On June 13, 2006 Samborn changed his answer to this question by stating that he would not comment on the issue at this time.

The following District Court local ">rule states:


"With respect to a grand jury or other pending investigation of anycriminal matter, a lawyer participating in or associated with theinvestigation shall refrain from making any extrajudicial statementwhich a reasonable person would expect to be disseminated by meansof public communication, that goes beyond the public record or that isnot necessary to inform the public that the investigation is underway, to describe the general scope of the investigation, to obtain assistance in the apprehension of a suspect, to warn the public of any dangers, orotherwise to aid in the investigation."


This allows the prosecution to inform the public that an investigation is under way. It also allows the prosecution to inform the public about the general scope of the investigation. Everything that takes place before the grand jury, is, of course, secret, but the “existence” of a grand jury investigation is certainly a matter of public interest. Indeed, Fitzgerald’s office has kept the public informed of the status of the investigation up until June 13, 2006 when he, via Samborn, refused to comment on the status of the investigation.

The same Federal rule would apply to the statements in Luskin’s fax. If Fitzgerald informed Luskin he does not anticipate seeking charges then Rove would be out of the general scope of the investigation and both Fitzgerald and Luskin may freely publicize that statement to clear Rove’s name. Whether it be a phone call, letter or fax, the medium does not matter, it’s all about the communication. Since Luskin made the communication public, the medium – a fax – can also be made public.

If there’s things in the fax which are to be kept secret pursuant to various Federal secrecy laws – for example: statements in the fax which discuss a sealed plea agreement – then Luskin can redact them and show what’s left.

On June 13, 2006, Fitzgerald, via Samborn, refused to confirm Luskin’s comments.

I believe that when one carefully examines Luskin’s razor sharp parsing, the truth emerges. Luskin has consistently stated:

1. Rove was never “indicted” or “charged” with any crime.
2. Rove never took a deal.
3. Rove has cooperated from the start with Fitzgerald.

I am not aware of any public statements by Luskin denying that Rove plead guilty to a legal infraction pertaining to Fitzgerald’s Special Counsel investigation.

If Karl Rove has not plead guilty to making at least one false statement, then let's have an official denial from Luskin.

I have contacted Randall Samborn and asked him about the subject matter of this report. He hasn't responded to my questions at this time."

A simple statement will suffice. In other words, to get past this and succeed with the obstruction of justice charges- more evidence has to be presented....

And that hack of a judge, who wanted to squash the obstruction charges the federal judge needs to be dealt with.

Your investigation hit a snag, because of David Addington. Well you must have been prepared for this!
