Prosecutor: Lay, Skilling Hid Enron Fraud
Kenneth Lay, Jeffrey Skilling Used 'Harry Potter Magic' to Cover Up Fraud

HOUSTON (AP) -- Enron Corp. founder Kenneth Lay and former Chief Executive Jeffrey Skilling used "hocus-pocus" to cover up a massive fraud that brought down what was once the seventh-largest company in the U.S., a federal prosecutor said on Monday.

Lay and Skilling committed crimes "through accounting tricks, fiction, hocus-pocus, trickery, misleading statements, half-truths, omissions and outright lies," prosecutor Kathryn Ruemmler told jurors and a packed courtroom in closing arguments.

"In this courtroom, ladies and gentlemen, the cover stories have been blown. Mr. Lay and Mr. Skilling are still clinging to the cover stories," she said.

On a large screen, Ruemmler displayed for jurors a comment Lay made during his often contentious testimony that she said encapsulated the Enron culture that the two men nurtured and embraced:

"Rules are important, but they should not ... you should not be a slave to the rules either."

Ruemmler, pacing before the jury box as the eight-woman, four-man panel listened intently, said Lay and Skilling "lied over and over and over again" and "bent rules, pushed rules and then pushed over the line" in the years before Enron sought bankruptcy protection in December 2001.

The collapse left thousands jobless and wiped out billions of dollars from investors who believed their claims.

"That is a fraud. That is why we are here. That is why this matters," Ruemmler said. [

Kathryn (Kitty) Ruemmler has a way with words, is tough as nails and makes corporate evil doers tremble. To date, I am extremely proud of everyone on the Enron Task Force.

And Ms. Ruemmler has done an excellent closing argument.. I wonder if Ms. Ruemmler wore the shoes that Peter Lattman and bloggers on WSJ was talking about last week on... She made a fashion statement at the trial and a thorn to Lay and Skilling on those expensive shoes...

I can't imagine the pain and shock of the Enron employees upon learning they had lost everything in their retirement portfolios.

To play by the rules and have it crash down - my opinion is that finally I understood how the French could toss so many to the guillotine. That much anger and betrayal needs an outlet.

To let these a**holes languish in jail is way way too good for them.

For Lay and Skilling to play dumb probably to avoid all the civil litigation that I hope comes their way, shows they have no morals, no conscience and no humanity.

I am confident the jury will understand all they had to wade through. Financial evil is hard.

Harry Potter vs Voldemort yes Sean team will win without magic just the truth. Now as for magic its to late for that Lay and Skilling are well cooked. The worked for the evil master and now they pay the price for those crimes. But I love it that Fitz reconizes what I can relate too and that's Harry Potter you really know how to make me smile oh and relate.

"This evidence directly contradicts the defense position that the defendant had no motive to lie. Instead, the evidence about the conversation concerning the Novak column provides a strong motive for the defendant to provide false information and testimony about his disclosures to reporters."

Fitzgerald says Cheney's notes on Wilson's column are important for what he calls some "principal reasons."
Fitzgerald write, "The article, and the fact it contained certain criticisms of the administration, including criticisms regarding issues dealt with by the Office of the Vice President, serve both to explain the context of, and provide a motive for, many of the defendant's statements and actions at issue in this case."
Prosecutors have alleged that over the five days that followed the column, Libby tried to undercut Wilson by telling a string of people Wilson's wife worked at the CIA and the Wilson findings, therefore, were tainted.

July 8, New York Times reporter Judy Miller.
On July 10 or 11, Karl Rove and Libby discussed the Wilsons and Rove said a column was coming from Robert Novak.
On July 12, Libby discussed the Wilsons with Time's Matt Cooper and again with the New York Time's Judy Miller.

The corruption is mind boggling - the Rethugs have certainly tried their best to absolutely TRASH this country - and for what?
Power?

The fact is, this will pass. All of these people will be dead - and Bush will be remembered in textbooks as a major asshat. That is his legacy.

And the 29% approval rate will be shown as being a cemetary poll.

The saddest is our soldier deaths, for NOTHING. They did their job for NOTHING and they died.

May Bush and Rove rot in hell for what they have done to our country.

Kit--these people already have no soul.

Does anyone know what will happen with WorldCom? I know one of the accountants sent to clean up that disaster but I have not seen him in months. Oh yeah, they are guilty . . . I mean innocent until proven guilty.

SPB--ABC does need to get new phones, as well as others. And no, no one is going to find out the source of that and why ABC got picked to get told that. Hey, I hear they can get lots of disposable phones from Wal-mart . . .

Hmm, maybe reporters will need Etch-A-Sketches next.

A Trial Among Us is the story of judged men, immured within the Marquette, MI maximum security prison, confined to administrative leave in Cell Block B,"The Hole." A hodgepodge of society, young and old, rich and poor, educated and ignorant, defiant and resigned ministers of faith, a doctor, college grads, jailhouse paralegals, arsonist, a wheel man, a murderer, sexual offenders, a drug trafficker. They all come together in B Block to be part of an organized society within the walls of steel and concrete.

Solitary confinement is man's greatest struggle with sanity, an isolated toe hold between reality and the alarming world of tormenting shadows and nightmares. The inmates of Cell Block B organize and implement a system within the walls of time akin to that of the one which passed judgment upon them on the outside. Holding mock trials within their block, they have a judge, prosecutor, defense attorney, bailiffs, witnesses and, in the hot seat this time around, Dr. Jeckyll, a doctor with the propensity to take advantage of his patients.

Sitting in the gallery, sucking up coffee and eating donuts, correctional officers and staff not only encourage the mock trial proceedings, but at times they participate in carrying out judgments. In The Hole, on the stand, there are no secrets::witnesses come clean about their lives and the offenses that led them to their present predicament. How else can you prove a judged man's credibility?

Within the pages of this true story, you will not find pretty little words, or political correctness in thoughts or speeches. This is the story of men who have erred and wish to make their atonement to society so that they may find an essence of peace within their own character and soul.

This story also deals with the revelations of tidbits of government information, revealed to us by an ex-CIA operative, and the corruption, abuse and even murder that once existed in a system that is by no means perfect, even today, in the Michigan Department of Corrections. You will meet inmates who will bring you to tears, and tumble into depths of compassion for them. Others you will want to personally punish, never seeing atonement or redemption in their souls.

This story was told to me for a couple of reasons, the first of which is to take you where doctors and psychologists can only dream of going, into the minds and souls of the judged and the convicted. Several of these inmates wanted their story told in the hope that others in society could benefit from their lives and not have to experience their torment and agony. There is something else they wanted everyone to know within this life of ours: The greatest judgments we face in life, are those we cast ourselves.

The greatest disease that can attack any human, is fear. Fear, which attacks your soul and murders your spirit. There has been a great deal of fear lately within society (fueled by those who govern and the mainstream media), a paranoia that confines the soul whether you are judged within a court of law or by the social pecking order.

By revealing the dark depths of events, secrets, tortured images and baring our souls, we hope that society will have a greater understanding and compassion for those who have erred and are serving hard time.

We can end the is-this-blog-for- real discussion now. I must apologize for posting something that was not well thought out--it could have been interpreted as insulting, although that was not my intention. I wrote something too quickly without thinking. It is something that I will not repeat, it disappeared, and I am sorry for not thinking before I wrote it. Only The Man Himself or a close associate would have cared enough to make it disappear.

So, although that is not evidence that could be used in court, I am concluding that the blog is real, folks.

For another misunderstanding--buried somewhere on here is something about Jesuits. SPB--I know nothing about Jesuits, so somebody confused me with someone else.

He's good at that you know. He and his team have worked so hard for this. I'll enjoy seeing their faces with smiles because it shows Americans that we are still the best country there is and we do clean up our own house.
