CONCORD, N.H. - Former Republican Party official James Tobin will serve 10 months in a federal prison for his part in a scheme to jam New Hampshire Democrats' get-out-the-vote phone lines in 2002.

Tobin, 45, of Bangor, will serve more time than either of his co-conspirators. A federal judge also sentenced Tobin on Wednesday to two years of supervised release after he leaves prison and ordered him to pay a $10,000 fine. U.S. District Judge Stephen McAuliffe ordered Tobin to report to prison June 23 and recommended he be sent to a minimum security facility. [more]
Lead prosecutor Andrew Levchuk, who works for the U.S. Department of Justice in Washington, D.C., said outside the courthouse that it "was a fair sentence." Nice job, Andrew!

And I have to agree with the judge. What Tobin did is an assault on free and fair elections. And Andrew Levchuk did a wonderful job convicting Tobin. But, his sentence should been more than 10 months (again, this is only my opinion)... Tobin violated people's freedom and intergity of elections.. I am remembering back to Martha Stewart's case. She was charged with obstruction of justice and lying to investigators in 2004. She was sentenced to 5 months in jail and 5 months in home confinement and fined $30,000 which is more than what Tobin is fined.. Even though these are two different cases with different charges Tobin was guilty as sin and Ms. Stewart was simply set up and punished (and so was her friend and ex-CEO of ImClone, Sam Waskel)for selling her ImClone shares and for being one of the most influential businesswomen back then.. But, nevertheless, justice was served for Tobin... Good job, Levchuk...

SPB, I agree 10 months doesn't seem like enough time for what Judge McAuliffe called a "direct assault on free and fair elections..." But at least one of the bad guys is out of the picture.

Patrick my friend, can you see if the DOJ will investigate the county in North Carolina (my home state- yea I'm a heel but in a nice way. Go Tarheels) that gave Bush over 6000 votes?

The strange part of this is there were only 1,400 or so registered voters in that county)
