Personally, I think this was not just a "leak" but a conspiracy and like the Wilson's Attorney said, "it does not end the matter."

But Lawyer Luskin is not the authority of this case, and he is hardly any voice of trustworthiness...

You continue to believe what you like, but we know the truth and what Fitzgerald's staff said here.

That fact is CR-0128 is still filed as an indictment under SEAL

And he has not revealed it yet, given that we know pretty much how Fitzgerald does his work....

Just like he did not tell the world what he did May 12 (except for wayne madsen...) he also did not tell the world what he did this Monday.

He's playing a definitive game and that is the reason for the secrecy and the blackout.

Weeks ago the real Fitzgerald put up court documents here and he is quite serious about the sealed indictment....

Until we know about Cheney that is, the trolls can pretty much shut their yaps as Biloxi would say. ;-)

Fitz, get out there and rope in Cheney and then GET THAT INDICTMENT UNSEALED for the world....

Jason will be vindicated once he knows what they did, and the fishing strategy....

Well you see, all Fitzgerald really had to do is tell the defense attornies Rove's status had not changed.

That is all he essentially did, and Robert Luskin spinned it that this was a "fact" his client was in the clear and would not be charged.

Remember, Fitzgerald did this in numerous cases where there was political pressure..Including the Governor Ryan trial.

Even though, in reality, 06-128 is still on the Judge's COURT DOCKET and is a sealed indictment in this case for now.

So when say, Fitzgerald decides to cut him loose at the opportune time they have the testimony against Cheney....they will be able to unseal it, thus voiding any of the pressure from the administration.

Remember, the White House has been putting constant pressure on prosecutors...so they are having to play it by the book, in an underhanded crafty way.

Right Biloxi?

So Fitzgerald to take a break has come to his blog etc, but is really looking how to drop two birds with one stone...and use Rove's co-operation against the other until he no longer needs him!

I wondered why RawStory kept posting new pictures of Rove every hour; ack! RawStory, btw...seemed to have changed its style of reporting about 2 months ago, IMO.

Did Rove roll over on Cheney so he wouldn't get charged? BTW, I'm from Kansas and Dorothy's Ruby Red Slippers were stolen a couple of years ago...just like our country is being stolen while our sons, daughters die, their future is sold off for the sake of the corrupt rich with their arms sales and WORLD DRUG TRADE.

Similar to the Conrad Black court case, pending criminal charges against Rove have been sealed for now.

Former Fed will understand any of this since he's a former official.

Of course, this means that we have almost assuredly secured his testimony against Cheney.

When all is said and done, you will learn what "128" is and what it is doing on the court.

Wayne Madsen is as usual, correct about this.

Karl Rove, like David Radler, is nowhere in the clear. When the time comes he will be scrutinized.

Let's go the topic of the discussion: ROVE

1. Rove was never charged by Fitzgerald with leaking the CIA covert's identity.

2. Rove is certainly not off the hook of criminal charges that WILL arise very soon

Fitz will get Rove on obstruction of justice and perjury for sure... Folks, I know that the beginning for Fitzgerald's case was mainly about finding out who leaked Ms. Plame Wilson's identity. But, we will never know WHO exactly leaked Valerie's name from the get go because there were multiple players involved in leaking Ms. Wilson's name. But, through Fitzgerald's investiagation, he undercovered a WH conspiracy. As Jason Leopold has written last year, the Fitz created a timeline of the events that involved certain major key players involved in discredit Mr. Wilson. By discrediting Wilson, it would have foiled the WH's plans to invade Iraq. Get the picture.. That is why Libby was never charged with leaking the CIA covert identity. He was charged with lying to the investigators and making false statements. We don't know WHAT exactly Rove told the GJ and Fitz on his many testimonies. And we know that there were inconsistent.

Now, I'll just cut to the chase. Where does this case go since Rove is not charged? As the article from Wayne Madsen report that S-Q and another bloggers passed along, this case is a lot bigger than you think. It is a WH conspiracy. I read that article this morning about the link with ousting Plame/Abramoff. As WMR points out:
"In any case, Special Prosecutor Patrick Fitzgerald is now dealing with a much larger case with the same limited budget and relatively small staff of prosecutors and FBI agents."

And as Jason Leopold's article points out:
"The fact that the indictment has been under seal for more than a month also suggests that it involves a high-profile investigation, he said."
"Additionally, it's entirely plausible for a federal prosecutor to obtain permission from a federal magistrate or a judge, have an indictment unsealed for the limited purpose of having parts of it read to a defendant and his or her attorneys in an attempt to have the defendant cooperate with an investigation to avoid facing further charges, legal experts said."

This is a very high profile case folks. And expect alot of negativity and distortion about this case in the press. Expect more trolls on this blog to tell you "I told you, so!" But that is what Fitz and the DOJ office have to endure. That is called criticism. So, without a doubt in my mind, I always been 150% behind him. I tell him often that you will know who your friends are when this case is over.. The WH may think that they have won the battle with Fitz. But, Fitz will win the war. And those in media who are naysayers to Fitz's case will have egg in their faces when he brings down the entire administration. Amd I personally would give any if those naysayers a single and exclusive interview after this case is over. Let them read or listen to interview like everyone else. So, have faith in Fitz, folks. This will be rollercoaster and bumpy ride.

There is alot of pressure on Fitz and the DOJ office on this case.. Major players would want to botch this case because there was always a hidden agenda withe the Gerbil and company. Joe Wilson, John Doe (ex-CIA agent who knew that there were not WMD and who sued Porter Goss and the CIA for ruining his career), and others were targets by the WH.

I think Fitz's strategy is to let Rove's knucklehead attorney, Luskin, know that his client was not being charged with leaking the covert's identity. Both Rove and Luskin ran with that like a person who gotten a lollipop! And the media just made it headline news.. But, Rove doesn't get it. He is not off the hook on criminal charges and the WH conspiracy. Roger, just expect the media will have eggs in thier face when this case is over...

Leopold is not being mislead from his sources. There were some of the same source who informed him that Libby was being indicted by Fitz. These were the same sources who told him about Richard Armitage cooperating with Fitz since the beginning of the case. Leopold reported that in March. And around 3 months later, the NY news reports about Armitage. NY New was 3 months late because Jason knew about Armitage.. Let's not forget Jason's article in May that Rove was indicted.. But, people tend to forget that Jason's article says that Rove was charged with obstruction of justice and not leaking the covert's name.. You got read between lines from the media. That is why I just don't listen to media on T.V a lot. Some of the media are there to push the Gerbil's hidden agenda..

SPB, you are absolutely correct.

Fitz says things that can be interpreted by the naive or stupid in many different ways.

While there was pressure for him not to release the criminal charges yet, he still has a plan that he follows.

As we know the real Fitzgerald is short on staff, and is working with Zeidenberg on a monumental case.

Thats why they have a blog to begin with and why he showed us the SEALED Court Indictments this last week, when he was also discussing the information....

So you know it obvious is a tough job. And in addition to everything tied to the Plame leak now, so is the 9-11 Whitewash and Florida-Gate Jeff Fishers evidence.

That means everyone is working different aspects of a very large case...

And they have co-operation of Rove to go after Cheney now, that they didn't have before.

Mark my words he will get his desserts, because Official A and Official A+ as the court records here stated.....STILL has to answer to the Judge!!!!

saddened by this morning's headline, but not totally surprised...there is a shit-load of corruption going on here in our great nation...we have an AG that makes up the laws as he goes... an AG and some federal judges that are in Bush & Cheney's pockets...and an adminsitration that thwarts justice at every turn...a president that has circumvented 750 laws in the last 5 years...and these crooks play for keeps

and then we have PJF & his talented team...they are smart and they will not give away their hand before its time...they know what they are up against...there is more to all of this than meets the eye...I have felt this very strongly from around the time everyone was speculating on an impending indictment (Leopold, Schuster, other pundits, etc)...but I felt that things would not play out as most bloggers wanted initially (myself included)...however, I do believe this is not over yet...

a few things keep playing over in my mind...

First, a Hardball show when Rove indictment seemed imminent (about a week after Leopold's article and many were denying it) -- in this show Matthews asked a Newsweek reporter when the indictment was coming in a laughing tone...this reporter's face went white as a ghost and looked like "a deer in the headlights"-- he quickly said I don't know. Then uncharacteristically, Matthews quickly changed the subject like he knew he was touching fire...(I just got the eariest feeling that there are a lot of media and other people in the Beltway receiving enormous pressure to not go against this WH)

Second, I think there is more to Sealed vs. Sealed...but it may be awhile before we get the chance to know...

Third, PJF may be going after someone higher, or it's possible that another prosecutor has something on Cheney or the Gerbil and PJF knows it...

I still feel that another shoe is going to drop here this summer...PJF would not have taken so much time to make up his mind on Rove if he didn't have some interesting cards in his hand...

And when PJF plays his cards, I will drive to DC and personally place the Viagra pen in the courtroom for my Fitzie and his brave team...

To me Rove and Libby are small potatoes...I would rather see Lady Justice grab Dumbya and VP Elmer Fudd by their impotent...well you get the picture

Interesting that you mentioned John Doe, SPB. I noticed while the Exhibits A, B, and C posted here recently contained copies of Libby's testimony regarding the leak, they were given in reference to the "John Doe" case, not the Leak Case. I did not know what to make of it.

Re: this investigation, "stay the course" is taking on a real and true meaning. I hope none of the regulars who post here or lurk and read give up at this juncture. Anon, John Doe is not part of the leak case. Doe sues Goss in the CIA and his lawsuit is still pending. goss had tried to have the case dimissed. I found the article. E had sent this article to me sometime ago. It is a eye opener for sure.. John Doe knows Plame.

But how do I know Kerry won? The whole BBC team did an incredible investigation, and we found 3.6 million votes cast but not counted. It was called "spoilage" - and that’s everything from hanging chads to paper ballots that have extra marks, and are junked and thrown away – you name it.

But it’s not just anyone’s ballot that doesn’t count. Whose votes are they? We did a precinct-by-precinct analysis of whose votes were thrown away. If you are in a black majority precinct, the chance that your vote will be thrown in the electoral dumpster is 900% higher than if you’re in a white precinct. If you are Hispanic - 500% higher than if you’re in a white precinct. This also includes something called "rejected provisional ballots," a whole new gimmick. A million people were shunted to back-of-the-bus ballots called provisional ballots. And over half a million of those were never counted – never counted. And who made the decision not to count them? The Secretaries of State, like the Secretary of State of Ohio, who is also the head of the Bush reelection campaign.

And yes, I think Jason needs to out his sources. If there was and will be no Indictment of Rove, his sources lied. If any are lawyers at Patton Boggs, I hope they lose their jobs and their law licenses.

As for Joseph Wilson's lawyer's statement, it appears to me his lawyer is threatening a civil suit.

Will there be more indictments? I'm not ready to speculate right now.

If this was mathematics, the outcome would be irrefutable, and without contradiction.

Mathematicians don't need to know the outcome of a winning strategy - even if the moves of an event - (WH conspiracy) - are infinite and never ending.

I am currently in Munich, Germany and receiving treatment at a cutting- edge cancer clinic.

This is my third battle with bladder cancer but the prognosis here is very good. I think the discrepancy in treatment between U.S and German health-care providers is directly related to the interference in Americans' health care system by the FDA. Which we all know ties into the theme of AMERICA: FREEDOM TO FASCISM.

Dear Lovers of Liberty,

I am currently in Munich, Germany and receiving treatment at a cutting- edge cancer clinic.

This is my third battle with bladder cancer but the prognosis here is very good. In the United States I was told that I had very little chance, in fact, that I was a hopeless case and had no chance to survive. I am fortunate to be in a position to seek care outside of the U. S where I am receiving the latest in high tech cancer treatment and quality patient care. Do not be worried.

I am very confident of survival and that in this, my third battle with bladder cancer, I will finally kill it. The doctors here say that not only will I survive but leave here healthier than I have been in years.

I think the discrepancy in treatment between U.S and German health-care providers is directly related to the interference in Americans' health care system by the FDA. Which we all know ties into the theme of AMERICA: FREEDOM TO FASCISM.

I want to thank everybody for your ongoing support of this film. Based on the amount of emails, Internet activity and donations that we have received, I can tell that there are a lot of motivated Americans out there!

From the website alone, we've had over 500,000 downloads of the trailer and over 11,000 links to our website. We've screened the film in select U.S cities with sold out crowds and standing ovations. Just recently at Cannes, we had a standing-room-only crowd and another ovation for the film from the international audience of buyers and media.

And now the word is spreading to millions of more people worldwide via the Internet and there is interest from film festivals all over the world including Lebanon, Spain, Italy and Greece.

Positive reviews about the film are starting to come in (see below) and we also have multiple screens booked in five major cities for our July 28th release, which I' ll tell you more about next week.

To me this means that a lot of people are clamoring for a systematic change and the end of the New World Order and our film, AMERICA: FREEDOM TO FASCISM is primed to be the summer's wake up call.

But I am here receiving treatment for the next month, which makes fund raising and promoting the movie a bit difficult, so I need your help.

We need to raise at least $500,000 in donations to help with the release of the film. I'm asking for everybody to donate $100. If that is done, then we will have more than enough money to release this film on a nationwide basis.

If after making a donation - which is clearly the most important and necessary thing you can do now - you also wish to provide additional help, this is what we would need:

As SPB has noted, Jason Leopold is standing by his story, in interview on the Ed Schulz show.

PJF has issued no statement. Randall Samborn has said that he has no comment. To me this means that things are ongoing and that the only person spinning this story is Gold Bars Luskin, Rove's attorney.

If you remember Watergate, this sort of "my client is off the hook and is not a subject" was par for the course.

I'd wait to hear/read it from PJF himself. It sounds like typical tactics by Rove's attorney Luskin.

As for Jason -- He refused to out his sources and stands by the story, as does his editor.

My feeling is that it'd be wise to wait and see how this all shakes down.

Also ... Keep in mind the release of the Libby testimony "Re: John Doe " which was formerly marked secret. Released on May 24th I think. I think there are bigger fish to fry, so to speak.

Anyway -- Lay back and cool out and trust what PJF says, not Rove's lawyer.

I still think Rove is NOT out of the woods yet. He may be cleared of the "leak" charges but I think a big surprise is coming from Fitz! That is why there is "no comment" from his office. I think there is a whole new case just waiting to fry several! Not a leak but a conspiracy!

What in the hell happened between yesterday and 4 weeks ago when Jason Leopold wrote the Rove indictment article? SPB, Roger and others have had us fired up by their posts that Roves indictment was going to happen soon. We're told to just wait, Rove will be FROG MARCHED out of the WH and now we hear that Rove WILL NOT BE INDICTED.FROG MARCHED INDEED!!! Something is rotten in Denmark. And now I hear a rumor that Libby's case will be dropped very soon. The bad guys just keep getting away with murder. Nuff said.

Very interesting posts here. In all of my years hanging around a courtroom, I have rarely seen a letter from a prosecutor or Special Agent telling someone that there are no plans to charge them criminally when they have been a subject or target of an investigation (whether grand jury or administrative investigation), even though a decision has been made to not pursue criminal charges. Normally, the target/subject does not get anything in writing, and the investigation just goes away or focuses elsewhere. This letter that Luskin speaks of-- I would like to see it. Until we see the text of the letter, I think it best to refrain from commenting on what the letter means for Rove.

I have no doubt that we are seeing only part of the picture as of today and that, when the full picture is revealed, it will be something quite different from what we see today.

Interesting to see the Right trashing Fitz. Seems to me they had kinder words for Ken Starr. Somebody could have some real fun comparing quotes by the Right on Starr with their quotes on Fitz.

I've been wondering lately whether the limited number of DOJ attorneys available to Fitz is something that Fitz is happy with (perhaps because fewer attorneys makes it easier to manage a very high profile case, perhaps for other reasons) or whether it is an indirect effort by the Politicos inside and outside of DOJ to place practical limits on what Fitz can do. Comments anyone?

My sources tell that Karl convinced Fitz not to drop that house on him and not to take those ruby slippers off Karl because his feet would curl up.

This was not a pretty sight when it happened once before to someone else and many Munchkins still have nightmares about it.

Answer: I don't think that he should come forward to make a statement. As Fitzgerald has said that this is an ongoing investigation. By releasing a statement to the press, he would give Rove and Luskin more ammunition to try to do more damage control of Fitzgerald's image as an U.S. Attorney and a Special Prosecutor in the media. Like Randall said, no comment.

Subway:

Waxman and Conyers have been the ones spearheading for answers. You best believe that we will piles of work for the new Congress to clean up. But, I like Waxman's followup and follow through attitude on Rove. As for Joe Wilson, he still puts his trust in Fitz and this case. And this case is far from over...

Certainly if Luskin did not receive a letter or a call and is making a big lie I can't imagine the SP would let something like that stay out in public. He could just say that he has had no contact with Luskin or Rove to kill the big lie. Instead, it will hang out there as truth, screw up Leopold, Truthout and anyone else who has been clinging to the original May 13 story about Rove indictment.

This is fishy from both sides. Amazing how little any of us know about what is going on with our country isn't it?

Don de Drain: I think the answer is B (placing practical limits on Fitz). Fitz has always praised the Eckenrode, other attorneys involved in the case, the agents, and U.S. Attorney office in Chicago for working on the leak case despite many of them are working on other tasks and duties. With the less than 10 people working on this case and less amount of money spent on this case in the last 3 years (apprx. 700,000), the DOJ office should be applauded with a skeleton crew and a tight budget. Try comparing that to Ken Starr who had 50 + staff working on the Waterwater and Lewinsky case which cost 70 million. With this temporary setback of trust in the case fed by the media, the Polticios will try to do damage control to make it differcult for the DOJ office to continue this case since this case involves many key players from the WH!

SPB-- I realize that Fitz would not publicly campaign for more resources, but I have not seen concerned people outside of DOJ calling for the allocation of more resources to Fitz. Why hasn't someone started carrying that torch? (Or, is that torch being carried, but the story is being ignored by the media?)

This case is far from over with Karl Rove. As Fitzgerald told us here, he is going to work up to Cheney.

A sacrafice or two is amenable....and Rove will face his deserts at the end just like the Governor Ryan Trial.

Speaking of WHICH, that phony "AL ROGERS" has been exposed!!!

TROLL of the ages, Mr. Al Rogers and all his friends have 'splaining to do elsewhere...

The real story unravels..

As Mary will attest to, Fitz has lots of cards up his sleeve and keeps them all relatively close.

So, by parsing words and using them most carefully, SPB are you saying that not indicting Rove for the CIA leak is not the same as obstruction, lying, etc.? In other words, ok..you didn't leak Valerie Plame-Wilson's name, but you're not off the hook for being a lying sob that attempted to hijack this investigation with obstruction....or something like this.

If Fitz campaigned for more resources, I would tell you what the media and the Gerbil will say. Both the media and Gerbil would say that: "this will cost the taxpayers too much money" blah, blah, blah. But, the media never said a word about Ken Starr's cost to a President that just simply had oral sex (oh, I'm sorry inappropriate act) with his intern, lied about it, but never threatened National Security yet cost 40 million to investigate and impeach Clinton! I think people are fickled to what is happening in this case. With the Gerbil controlling much of the media, I think that there are people that are carrying the torch out there for Fitz but we are not seeing it in the media. The media is controlled. That is why blog site like Firedoglake are becoming more attractive to people. Money is attached to the hip for media and some journalists unfortunately. They are hooked to the milk machine at the dairy.. Being pumped hush money to push the Gerbil's agenda.. Just like the people pushed through those walls in the 60's,'70's, and Watergate era, so does Fitz!

Answer: Two separate charges, Grandmanuk. Rove was never going to be indicted for leaking Plame's identity just Libby was never charged for that. Obstruction of justice and lying to investigators is a different charge than leaking a CIA covert's name.. Rove gave very inconsistent GJ testimonies.. As I said we will never know WHO leaked Plame's identity first. This is what Fitz's invesitgation in the beginning: who leaked Plame's name. There were too many people who leaked her name that it differcult in a timeframe to pinpoint who leak her name first. But, this case centers around a WH conspiracy to discredit Wilson.. They found something to bring Wilson down a peg: his wife! Wilson has always said that there was more to the case than just leaking his wife's name. If Wilson's was discredited by the WH, there would have not been a war in Iraq as preplan by the blueprint of the Gerbil.. Former CIA George Tenet knew actually where King Gerbil was heading when the Gerbil gave those 16 words, he knew that there was no WMD...

Rove is not off of the hook, Grandmanuk. Not by a long shot!

Answer: That is the media feeding words to the public. The media used the word "leak" to assume that Rove was possibly be charged with the leak.. I think alot of you need to read Jason's prior articles really carefully. Let me see if I can find the article.. All I say is that this is still an on going investigation and notice that Luskin is doing all the talking about what the prosecutor tends to do with Rove.. That is why I say on this blog that I don't carry the T.V. media with a grain of salt as 100% accurate... And no, Grandmanuk, Fitz has never said that Rove is not going to be charged at ALL IN THE ENTIRE CIA INVESIGATION! Got to read between the lines with the media.. He is not off the hook...I hope I answered your queston... Geewiz, I am beginning to sound like Randall Samburn's spokesperson except he says "no comment."

Good morning from an overcast but still pleasant southern Vermont home to THE BEST artisan cheeses and other "specialty foods."

I continue to have faith that justice will prevail.

I was interested to read a few weeks ago that George Tenet's book is coming out in 2006. Anyone know if that's BEFORE the election? Anyone read anything about how far he is willing to go, or is this going to similar to Tommy Frank's book that seems to have omitted a few things?
