Dear Lovers of Truth & Justice,
Hopefully, this e-mail will answer many questions regarding the procedures the Government is contemplating in anticipation of distributing the Libby grand jury exhibits on Wednesday February 7:
No materials will be provided until the remaining portion of the grand jury testimony and exhibits have been published to the jury, which is expected to take approximately 2-1/2 hours. Without making any promises, the Government will endeavor to make the exhibits available as soon as practicable; so, if the presentation is completed at lunchtime, we will make every effort to push them out during the lunch recess. If the presentation is not completed until after lunch, we will monitor the flow of the trial and determine the best time to proceed, which might not be until the Court adjourns for the day in an effort not to disrupt decorum or interfere with Mr. Russert's testimony. If there are any extended breaks in testimony, we will consider available options at that time. There are three categories of exhibits:
1) The audio -- each grand jury session -- March 5 and March 24, 2004, will be in an mp3 file on a separate CD, so there will be a total of two CDs in a set. These will contain audio only; the transcripts are not merged with the audio as you see in Court. When each file is opened in a Windows media player or other platform, it will display the length of each file and provide a running time as it plays. We are attempting tonight and tomorrow morning to have available a reasonable, but by no means unlimited, supply of CD sets. We expect to be able to provide a single set to all major news organizations as we deem appropriate. However, if we run short, some copies might have to be distributed to organizations that agree to pool or duplicate sets on their own. (The CDs themselves may be copied to hard drives or other media once you receive them.) We will distribute copies in the first floor media center only and request that you please allow us to provide them in an orderly fashion. Please designate only one representative per organization to request and receive copies and we will keep a list of those obtaining a set. We will not be distributing the audio via e-mail and we will not posting the audio to our website until after the trial. In that regard, we will be making the audio available to the media only, and not to the public directly, at this time.
2) The transcripts -- there will be two files of transcripts, again one for each date, March 5 and March 24, 2004. We will use this e-mail distribution system to send the transcripts in pdf files contemporaneous with the release of the audio. The transcripts will also be posted to our website a short time later.
3) The grand jury exhibits -- similar to the transcripts above, there will be two electronic pdf files - one for each date, containing the exhibits that were used in the grand jury. These will also be e-mailed together with the transcripts and posted later to our website you can access via a link on the right hand side of this blog.

It will be interesting to see which news organizations do the best job at playing/reporting on these, and giving them the attention that they deserve.
And which news organizations fail to do so.
