Libby Locker Room In Turmoil...

It's not whether you win or lose, it's how you play the game

WASHINGTON (CNN)-- I. Lewis "Scooter" Libby's lawyers are debating whether to call Libby's former boss, Vice President Dick Cheney, to the stand, a source with knowledge of the lawyers' discussions told CNN on Thursday.

Libby's lawyers also are debating whether or not Libby should testify or throw in the towel and negotiate a plea, the source said. Ted Wells is arguing, "if Scooter takes the stand we are screwed," while William Jeffress is countering, "without Scooter we are screwed."

One compromise under consideration is to postpone the inevitable embarrassment of the Vice President pleading the Fifth by only playing video tapes of him on Meet the Press, saying:

"Tim, Scooter Libby is, he's a good man. He's a friend of mine. He's somebody--one of the most competent and capable people I've ever known. He's entitled to the presumption of innocence..."

and home videos of Scooter playing with puppies.

The source added, "as it stands now a decision has not been made about whether either will testify with the only points Wells and Jeffress agreeing on are the certainty of their client appealling his conviction and their fees."

Some in the defense team believe the prosecutor's presentation has been strong and persuasive and therefore would open both Cheney and Libby to a grilling when cross-examined. This would not help to sway the jury, the source added.

Originally, it was the expectation of the defense team to put both Libby and Cheney on the stand to help buttress its case, the source said, "but that was before the Prosecution called their first witness." <

I think Libby should plea guilty. Just the words on tape by Cheney will send him to jail. The word competent and honest stands out. Now the word competent vs. memory lost. Honest vs 5 witnesses that discount his testimony. Cheney is already by Libby's own words the person who ordered the leak while still classified as national security. The Little Angel will blow Cheney off the map and as for Libby he will be crying like the baby he is. Wells and Jeffies will do better for their client to wave the white flag now. Already the Wilson's case has been made with all involved even the Gerbil. Leaders from around the world know this White House are full of liars and crooks and don't tell the truth. I also noticed that many female jouranlist are talking a little to friendly about the Little Angel I'll keep an eye on that. Three cheers for Randall.

Perhaps the possibility of Cheney blurting out "I think you're out of line with that question" on the witness stand would be a real cause for concern for the defense.....

NEW: Libby's lawyers debating whether to call Vice President Cheney to testify

Here are my thoughts concerning the trial and the defense:

Fitz had a pretty much straight forward and no brainer opening statement that use a timeline of events to prove that Libby committed perjury. And Fitz pretty much rest his case with his strategy being very solid. Russert's testimony with Fitz was only 12 minutes. Russert's testimony with the defense lasted 5 hours.

The defense has left a lot of holes in swiss cheese with Libby's defense. For the defense, there are uphill without a paddle having Cheney take the stand because all focus on alot of testimony and the Scooter's GJ testimony audio are on the deep involvement of Cheney in the leak case. The defnese knows that Fitzgerald will hammer Cheney on the stand. But what leaves questions to the jury are:

a) why was Libby an scapegoat for Rove?

b) where is the evidence that proves the Libby just simply had a bad memory and didn;t intentionally lie to investigators according to the government's timelime?

I know that the defense wants to call the NY Times reporter to squash Miller's testimony. But, the defnese has a week an half with defense witnesses on the stand to get into the hearts of the jurors to favor Libby's defense. The possible defense witnesses, Rove and Joe Wilson, are left in limbo.

I just read that, Patriot Girl. He really had a hell of lot of nerve to make that remark especially taking about immigration. I know someone personally who came from a migrant labor working parents and who was mirgant labor worker as a child and now is a very successul person. But, this tells you how ignorant Rove is .

Just like when Cheney shooting the face off his friend took precedent over him going on Dian Rehm's show and admitting that he 'insta-declassified' and how he has the 'authority to do so'. Nobody remembers though. I've been trying to dig that one back out of the archives but can not find it when I search NPR website.

No actually, that was just a snide joke but-

D.C. is once again a cesspool, and Biloxi is right on that D.C. needs a major enema job.

And getting rid of the Cheneys is only one part of that job.

Both parties need to be cleaned and it doesn't matter if its AIPAC, Exxon Mobil or the BET- the entire town needs to be scrubbed of all the loopholes for these lobbyists.

The lobbyists have run this town for more than long enough....its time they pack it up!

Play by the rules or ship out like the smirk on Lieutenant Dumbsfeld's face!!

Libby was born in New Haven, Connecticut, to a Jewish family and raised in Florida. His father was a successful investment banker. Various sources report that his given name is Irving (or give common abbreviations for "Irving," such as "Irv" or "Irve").

Hello Fitzniks, Jackie, SPB, and all of you wonderful THINKING humans...

I was being sucked alive by the blog/news and had to go away and recoup for awhile. I am so delighted to see that the fruit is very ripe for picking indeed and our fearless leader( whether he likes it or not) is proving yet again his nobility, tenacity, honesty, intelligence...well, I can go on and on....

Thank God, for you Fitz! You make many of us unseen and unheard feel like there is someone that does see and hear, and is lookin out for us, US, this country of ours.

I stand by my previous comments that neither Cheney nor Libby will take the stand in the trial. If Scooter takes the stand, it will cost him come sentencing time under the sentencing guidelines.

If Wells and Jeffress ever acknowledge that both of them are correct in their statements about Libby being screwed, then they should be smart enough to understand that the "least worst" option is for Libby to cut whatever plea deal that Fitz is willing to offer. And Fitz, if he is smart, will offer Libby something in the plea deal to make it better for Libby than if he was convicted by the jury.
The question is whether Libby has the guts to tell his lawyers to stop arguing and cut a deal with Fitz.
