Libby Locker Room In Turmoil...
WASHINGTON (CNN)-- I. Lewis "Scooter" Libby's lawyers are debating whether to call Libby's former boss, Vice President Dick Cheney, to the stand, a source with knowledge of the lawyers' discussions told CNN on Thursday.
Libby's lawyers also are debating whether or not Libby should testify or throw in the towel and negotiate a plea, the source said. Ted Wells is arguing, "if Scooter takes the stand we are screwed," while William Jeffress is countering, "without Scooter we are screwed."
One compromise under consideration is to postpone the inevitable embarrassment of the Vice President pleading the Fifth by only playing video tapes of him on Meet the Press, saying:
"Tim, Scooter Libby is, he's a good man. He's a friend of mine. He's somebody--one of the most competent and capable people I've ever known. He's entitled to the presumption of innocence..."
The source added, "as it stands now a decision has not been made about whether either will testify with the only points Wells and Jeffress agreeing on are the certainty of their client appealling his conviction and their fees."
Some in the defense team believe the prosecutor's presentation has been strong and persuasive and therefore would open both Cheney and Libby to a grilling when cross-examined. This would not help to sway the jury, the source added.
Originally, it was the expectation of the defense team to put both Libby and Cheney on the stand to help buttress its case, the source said, "but that was before the Prosecution called their first witness." <more>
