W pushes envelope on U.S. spying

"WASHINGTON - President Bush has quietly claimed sweeping new powers to open Americans' mail without a judge's warrant, the Daily News has learned.
The President asserted his new authority when he signed a postal reform bill into law on Dec. 20. Bush then issued a "signing statement" that declared his right to open people's mail under emergency conditions.

That claim is contrary to existing law and contradicted the bill he had just signed, say experts who have reviewed it."

Another task for the new Congress: Stop these signing statements!

I am not a lawyer, but I think your ideas about how to address these signing statements make sense. I hope SPB will weigh in on this, as well as anyone else who has some expertise in this arena. But, somehow, this little man's power to override laws with these signing statements must be curtailed. It is hard to believe that there could be no way to accomplish that.

It's Thursday!

I wanted to address Grandmanuk's question to me about new latest pet project by the Gerbil regarding the right to open people's mail under emergency conditions. Yes, I read about this morning. And yes, he sneaked this in before the 110th Congress was sworn in. I know all of the bloggers are upset once again by his domestic spying. This is still under Bush's Patriot Act.

Yes, this is still Bush's abuse of power and his violating the Constitution. But, we all have to contact our Congress person in our area to demand a hearing into the President's abuse powet of domestic spying. Now, I personally emailed Senator Feingold this morning on the status of his pursuance into Bush's abuse of power of domestic spying, Patriot Act, and wiretapping. He was the lead person who wanted a censure for the President. Now that the 110th Congress has been sworn into office, it is time to demand that investigation. And I am sure that there will be an investigation into Bush's latest thing. But, I hope people do not sit by and expect this Congress to make this happen. It is also our duty to followup and follow through with Congress since we put them in office.

Speaking on Feingold, here is new information on his website of the 110th Congress:

January 3, 2007

Washington, D.C. – Tomorrow U.S. Senator Russ Feingold will again introduce legislation to establish a timetable to redeploy U.S. troops from Iraq. The legislation builds on Feingold’s effort in the last Congress to end the military mission in Iraq in order to focus attention and resources on our top national security priority: defeating global terrorist networks. Feingold’s legislation would require the administration to submit a timetable for the redeployment of U.S. forces from Iraq within six months. The bill would allow a minimal number of U.S. forces to remain in Iraq for targeted counter-terrorism activities, training of Iraqi security forces, and the protection of U.S. infrastructure and personnel.

And here is statement from Waxman about the Gerbil's pet project:

"Despite the President's statement that he may be able to circumvent a basic privacy protection, the new postal law continues to prohibit the government from snooping into people's mail without a warrant," said Rep. Henry Waxman (D-Calif.), the incoming House Government Reform Committee chairman, who co-sponsored the bill.

SPB, does the Hairy Miers resignation mean she could be called to testify about him now that she isn't representing him anymore? How does that work? I know she has a paper trail from Bush. He is bound to go to trial for something in civil or criminal court.

I received an email message from Waxman's office. Yes, I bugged his office about the Gerbil's pet project. I spoke with his secretary live over the phone. Here is the information about the Gerbil's new postal bill:

First of all, the bill is H.R. 6407 Postal Accountability and Enhancement Act." The secretary walks through a website that I can look at that particular bill that was sent to Congress. I typed in that bill. That bill was sent to the 109th Congress and it passed and then sent to Senate and it passed. The only thing is that what Bush added in that bill recently was not in the bill when it passed in Congress and Senate. He snucked that clause of opening people's mail with a warrant for emergency reasons. That bill that passed through Congress and Senate never mention anything to what Bush had signed. Waxman's secretary is unaware of what exactly Bush's purpose to open up people's mail. His office will get back to me to answer what is exactly Bush's purpose to open up people's mail: Is it for the purpose of National Security or Terrorism?

According to Bush's website, "The executive branch shall construe subsection 404(c) of title 39, as enacted by subsection 1010(e) of the Act, which provides for opening of an item of a class of mail otherwise sealed against inspection, in a manner consistent, to the maximum extent permissible, with the need to conduct searches in exigent circumstances, such as to protect human life and safety against hazardous materials, and the need for physical searches specifically authorized by law for foreign intelligence collection." Yet, this is unclear is this involves terrorism..

From that conversation with Waxman's office, I am sure that all of Congress and Senate are unaware of Bush's new tactic. And this new clause into the Gerbil will not fly with the new Congress."

The Associated Press quoted White House spokesman Tony Snow as calling Miers "beloved" in the Bush White House. Snow explained she had resigned because, "Basically, she has been here six years," adding that "somebody said earlier today 'She put 12 years of service into six years,'" Snow said.

He also believed that Miers exit didn't signal an exodus from the lame duck White House.

Miers also became known for leading White House staff in "ethics" training after various scandals struck the Bush administration.

Yes, Grandmanuk. I hear you loud and clear. What I say earlier is that President Bush purposely snuck this amendment into law when 109th Congress was out of session. Yes, the proper process is that a bill is that presented to the House/Senate and if that passes, then it goes to the President. But, we are talking about Bush who has altered the Constitution for the past 6 years. If you read my comments above regarding Henry Waxman's office, this lets you know that new amendment by the Gerbil has to go through the new Congress. And Bush calls it a "signing statement." That bill is not a privacy protection especially for businesses to have to send mail and packages to other businesses. So, this is a serious issues. But, I know that you are upset about this Grandmanuk as everyone else. But, it is the time to followup woth your Congressperson in Michigan.

CJ: Miers(whether she was still stayed at Bush's attorney) can testify or can be subpoena and so can any WH employee. Miers may be the Gerbil's attorney but she is like anyone else.

offically becoming the nation’s second African-American elected governor. Patrick will “take the oath of office on a Bible given to John Quincy Adams by kidnapped Africans whom Adams helped free in the Amistad slave ship case he argued before the U.S. Supreme Court in 1841.”


Man, I really admire both Ellison and Patrick as they are teaching us history. Ellison is sworn in by a Koran from Thomas Jefferson and Partick is being sworn in the bible from Adams that was given to Adams from freeing the slave ship on Armistad. And I read on Admas' work regarding Armstad..

Congress and the U.S. Securities and Exchange Commission have focused on excessive executive pay in recent months. In July, the SEC began the biggest overhaul of rules covering compensation in 14 years, calling on companies to expand the information they provide to investors about the salary, incentives and perks given to senior executives.

U.S. Representative Barney Frank, a Massachusetts Democrat who is the new chairman of the House Financial Services Committee, said yesterday that he would hold hearings on executive pay and will push for legislation to give shareholders greater say over what CEOs make.

Does anyone really believe these CEOs are worth a portion of the money and perks that they are paid?

"High" in the legal parlance of the 18th century means "against the State". In democracies and similar societies it also includes crimes which attempt to alter the outcome of elections.

The first impeachment conviction by the U.S. Senate was in 1804 of District Judge John Pickering for the high crime and misdemeanor of chronic intoxication. Federal judges have been impeached and removed from office for tax evasion, conspiracy to solicit a bribe, and making false statements to a grand jury.

In the impeachment of Bill Clinton in the late 1990s for perjury, the exact meaning of the term high crimes and misdemeanors became the subject of debate. A particular subject of debate is exactly what rises to the level of high crimes and misdemeanors. Some felt that the act of perjury, a federal crime, certainly rose to that level. Others felt that perjury, while illegal, did not reach that level.

It is evident that in the absence of a clear legal definition, determining what rises to "high crimes and misdemeanors" is an inherently political process, which means that it is up to Congress and what it thinks constitutes an impeachable offense.
