Cheney's Smokin' Gun Pointed At Bush...

Cheney's Handwritten Notes Implicate Bush in Plame Affair
Handwritten notes by Vice President Dick Cheney, introduced at trial by defense attorneys for former White House staffer I. Lewis "Scooter" Libby, would appear to implicate George W. Bush in the Plame CIA Leak case.

Bush has long maintained that he was unaware of attacks by any member of his administration against [former ambassador Joseph] Wilson. The ex-envoy's stinging rebukes of the administration's use of pre-war Iraq intelligence led Libby and other White House officials to leak Wilson's wife's covert CIA status to reporters in July 2003 in an act of retaliation.
But Cheney's notes, which were introduced into evidence Tuesday during Libby's perjury and obstruction-of-justice trial, call into question the truthfulness of President Bush's vehement denials about his prior knowledge of the attacks against Wilson. The revelation that Bush may have known all along that there was an effort by members of his office to discredit the former ambassador begs the question: Was the president also aware that senior members of his administration compromised Valerie Plame's undercover role with the CIA? <more>

I had to skimmed over the Wilsons' file. Here we go.

Judicial Watch addressed important issues of laws raised by Cheney.
Judicial Watch is a not-for-profit organization that seeks to promote accountability to the rule of law.

According to the filing:

Judicial Watch is particularly concerned about the Vice President’s assertion of absolute
immunity. Second, the absolute immunity advocated by the Vice President is based largely on an overly broad interpretation of Cheney v. U.S. District Court, 542 U.S. 367 (2004), a case in which Judicial Watch was a party.

On page 2, Cheney argues his case based on Nixon Vs. Fitzgerald (1982). According to filing, ). In his brief, the Vice President contends that the Amended Complaint should be dismissed in its entirety because “the Vice President of the United States is absolutely immune from civil suit when acting in his official capacity.”

Judicial Watch is stating thst Cheney is not grsnted absolute immunity. On page 3:

Contrary to the Vice President’s contentions, the U.S. Supreme Court did not recognize a
blanket, absolute immunity for the President in Fitzgerald. Rather, the Court held that, under a
certain set of circumstances, the President is entitled to absolute immunity. In fact, the Court clearly confirmed that there were circumstances under which the exercise of judicial jurisdiction over the President was warranted.

Footnote:

"The Vice President also argues that U.S. CONST. amend. XXV justifies absolute
immunity for the Office of the Vice President. Mot. to Dismiss at 20. However, in the event that
U.S. CONST. amend. XXV became necessary, the Vice President would no longer be acting in his
role as Vice President, but instead in the role of President, affording him all of the powers and
duties of that office. Triggering U.S. CONST. amend. XXV does not grant absolute immunity to
the Vice President. Rather, it makes the issue moot."

The phrase “absolute immunity” does not appear in the Court’s opinion. In this civil lawsuit case, Cheney is being sued in his individual capacity, not in his official capacity.

Well Cheney has been functioning as the de facto president for so long, that he may think that he can claim absolute immunity. What arrogance if that is the case. And, there's no way that this ball of fecal material did not start at the very top of the heap. I'll bet Karl Rove is not having a peachy time these days and I'll bet that Bush is not sleeping as well as he wants everyone to think he is (without major meds). Will the media report the Smokin Gun information or will they follow orders and bury it so the TV viewers never know that Bush now has an impeachable offense and his been lying for 6 years. Cheney is certainly toasted of trying to claim "absolute immunity." He screwed three ways:

1. Cheney is being sued in his individual capacity (unlike the Clinton vs. Jones case where Clinton was sued in his official capacity).

2. Clinton was denied by the Supreme Court immunity of being sued in a civil suit as a sitting President. And since Cheney is a V.P., there is not law written that says that a V.P. is granted absolute immunity from a civil law suit.

3. Since Cheney is pleading his case based on Clinton's impeachment, one thing that Cheney has to keep in mind is that the Supreme Court ruled that Clinton can be sued in a civil suit whether he was a sitting President or ex-President and private citizen. And since Cheney is trying to claim the title, co-President, Clinton's impeachment and Clinton's civil lawsuit will work against him.

Impeachment proceedings aren't necessary, but criminal ones are. You cannot make impeachment charges stick, it won't work. Name one President to have been successfully impeached. Treason charges won't work either, because they are equally difficult to establish under the criteria of how they are tried. It's the 200th anniversary of the the Aaron Burr trial, I advise all to do a search on it. Or, read my article on it at my blog! ;0)

Yup.. The Wilsons' attorneys got Cheney's number. And notice that Cheney is the only one out the group fighting absolute immunity and not Rove and Libby. And of course, Libby and Rove can't claim immunity at all. This will be an interesting case of these three as they are being sued as individual officials. Cotchett and Sloan are very clever attorneys for the Wilsons.

Team Fitz is one thing to read about another to see in action-whoever said trials were boring isn't watching this one! Was that Wells inferring that "the president" leaked classified status, hmm? Sure sounded like it-too bad the jury missed that part.

Wells is even more irritating in the flesh-he is the cockiest stuffed shirt I've seen in a long time...and I've seen many.

Jeffers could easily pass for a used car salesman by day, who hangs out at smokey dives hunting for bar flies by night.
I don't like his style and hes dumb for speaking to the judge in such a rude manner like he did this morning. I was astonished at that.

Fitz only one complaint about you and its not mine-but you might want to keep it in mind for others. Sometimes you talk too fast for people to catch everything-not me-I didn't even notice until someone said something (a future law student was having problems keeping up) sooo New York minute boy slow it down (I talk too fast also;-)

This case is all over the place with more leaks then ever. Now we know Bush/Cheney were committing Treason as noted with the Smokin Gun.
I didn't know what Wells was up to now I think I know. He is going to make the jurors think of Libby as the victims by Bush/Cheney. Now yes he lied or so called lost memory but spin this case for the jurors to feel Libby was used and give him pity for his actions of lying. It's called the Powerful men using the little man. It's the simply vote or root for the underdog. That's the only way out for him as he is guilty as hell. Now Wells will pour out the information that Libby has on the White House in hopes the jurors are more mad at Bush/Cheney then him for lying. Cheney thinks he has executive privilege like Bush so he feels he can't be charged with the crimes he committed. Yes Bush and Cheney committed treason by leaking a covert agents name so let's see how that plays out the people and the government.

Thank you Night Owl that's what I was thinking. Now it might not work for the little soldier but it's his best shot. We still don't know who much more information that the Defense has on Bush/Cheney. I know the jurors will find Libby guilty but Libby is going to take others with him and hurt them as much as possible.
Fitz is only interested in the time line and the lie but Wells is trying to change the focus of the case. I know my Little Angel will stay on track and not get drawn into the Defense story. It's all about his state of mine and memory. " I didn't do it" was the state of mine, asking legal questions to a lawyer is state of mine and talking to Ari is state of mine. Now being used by Cheney is out of his mine.

I was just thinking of something now I'm mad. Wells had Fitz and the team spend all that time going over everything and aruging about what can be heard in court over 400 plus classified documents when the Little Angel could have gone to the movies to see Happy Feet and Charlotte's Web. Now he'll have to get the DVD. Now the padawans were busy too. I know there were alot of movies they missed also. Time wasted for what now Wells wants to question before the time line and after the time line. Libby's on a mission to destroy the Bush/Cheney criminal team. I'm going to try and relax now talk to everyone tomorrow.

This is great, I love the little hand-scratched off item "this Pres". Been staying away , weird stuff a while's past for my book but I have to take a peek here, because this is the jist, this is where the crime lies, the crime inflicted upon us, the citizens of the USA. This is where it started in my limited book, where that Special Prosecutor spied the germs of the crime against us... I hope we can get the entire country to see what has happened to us, and lead us upoon a safer path. I have little kids, and some of you others here do to... We have to make our country safe from them,this present administration, and their lies, or there may not be a fine Jeffersonian Nation left,not to anyone, not even the Golden Eagles or the Red Tailed Hawks ( not to mention the Polar Bears...)

Not just our country, but the world-Cheney is mad with power and will not hesitate to propel us into a war with Iran to take the press off of his testimony or indictment-Please bring him down!!!!!for us, and all of the people of the world (Iraqis to date) -but many more to come if we are thrust into WWIII. I pray for God to give you strength and courage.
