Update on Senator Johnson's health

If the situation arose where a replacement were needed for any Senator at this point, the American people have spoken. No one governor should overturn the will of the majority of Americans. The "right thing" to do if he died or could not serve would be to appoint his wife (or partner if it) to serve out his term or until a special election could be held.

"The way to prevent this from affecting the balance of the Senate, if Sen. Johnson's life is still imperiled, is to put political pressure on the Governor of SD to appoint a D and to seek to win as many governors as possible. Bleating about someone "trying to steal the election results" by applying the laws just shows you to be *a WHINER who dislikes following laws every bit as much as the Republicans when they don't go your way*."
I agree that if something happens to Tim Johnson that either his wife, Barbara, or a family member step in until his term come up and a special election take place. When Sonny Bono died, his wife stepped in his spot in his elected position...
But, this is all too soon to discuss whether Tim Johnson is going to die or not.. This is the GOP talking that wants control over the Senate. So, I am sure that Tim Johnson has already discussed with his family and close friend, Harry Reid, his plans should he die or be incompacitate.. So, all and all, the GOP vultures and Fox News can put away their shovels...

Here is the Biloxi breakdown of the latest of little Irve's trial:
In his filing, he is basically saing that no one will asset a "blanket" privilege in order not to testify. Blanket meanswitness to the government will not object to answering all of the questions, but they might raise a privilege objection as to the defense’s questioning.At least we know that Dick Cheney and other witnesses can’t claim privilege during the government’s questioning.
Team Fitz:
1. Will intend to introduce all of Libby’s grand jury testimony as exhibits for the jury. The Government will only refer to specific portions. Those portions are not yet to be determined
2. Judy Miller and Tim Russert are expected to be the government witnesses.
Team Smurf:
1. Will subpoena a tape recording between Bob Woodward and Richard Armitage. This tape was the inadvertent comment by Armitage to Woodward about Plame’s job.
2.Little Irve has issued subpoenas to several news reporters whom he will call as defense witnesses.
Of course, I believe that Fitz will call Cheney because Cheney is the key to Fitz's case in regards to perjury by Irve. Cheney’s testimony can help Fitzgerald to raise doubts in Irve’s defense that he was too busy with National Security matters that he forgot his conversations to reporters concerning Valerie Wilson. Fitzgerald could argue that Valerie Wilson was a key concern to Cheney and thus it would have been important to Irve.
It would be interesting if Fitz would crossexamine Cheney about the March 9, 2003 meeting that Cheney spearheaded in regards to Joe Wilson and Cheney’s handwriting notes on a newspaper clipping about Joe Wilson and his fixation on Joe Wilson. Cheney wrote on the newspaper clipping:
“Have they done this sort of thing before?”
“Send an Ambr (ambassador) to answer a question?
“Do we ordinarily send people out pro bono to work for us? Or did his wife send him on a junket?”
Cheney is an important key to prove Fitzgerald’s case and the key to prove the theory of a White House plot to punish Joe Wilson. And it isn't ironic that Cheney would use the same Nixon playbook to get him out of this mess and use the same attorney that Clinton used in his Paula Jones case. And this is the same Bill Clinton that was told by Congress that he had no executive privilege as a sitting president and out of office President. Yet, Cheney claims that he has executive privilege as the Vice President as Clinton didn't have as a sitting President. Priceless! LOL!
