Experts said the Libby defence claim is similar to a challenge the Supreme Court rejected in 1988, in the Morrison v. Olson case.
Though the independent counsel worked outside the executive branch, the special counsel regulations were written to work within the executive branch, legal experts said, and the attorney general has authority to deputize someone to prosecute the nation's laws.
Didn't work then, so why should it now... Don't they have anything better to pull out of the hat?

Presidential authority stops at the place independence begins; your desk. Since when would a potential witness or defendant-the AG-be permitted to appoint anyone in this case?

Look Fitz all this is show time. First if Gonzo tried to remove you it would show the true guilt of this Administration. Second what did you expect Libby has used memory loss, problems of fighting in side the Administration, classified information to show he's been busy next he'll use Lay's defense that a coconut fell on his head. When a criminal has no defense he/she grabs at anything and everything. Libby is begging for money from people he has to show them that he is not guilty or they wont give him money. You know the world of the govenment and how these crooks and liars work. Don't get caught up in the moment just ride with the tide.

e when you chose to win at any cost be carefull what you wish for. As you noticed for Libby to defend himself information on the illegal invasion of Iraq will come out. That information would blow this Administration of the map. The question is will the little soldier risk the impeachment of the President to say himself from these obstruciton of justices charges. As for Fitz working hard for his money well you might want to look a little closer at Fitz he's much more then the money. As far as someone in the WH that wants Fitz to win well everybody wants to be on the side of a winner. Look at how fast people are turning on Bush as he goes down hill. No one wants to be on the losers side.
O.K. here we go again... The idiots come out of the woodwork. Libby doesn't have a case. period! His lawyers are trying everything under the sun to discredit Fitzgerald. I realize Fitz that this hard on you to fight for your position and this case against Libby's lawyers who are just bleeding Libby dry and the little soldier using the Gilligan defense. I agree with Jackie that the Administration are fighting internally because their plans are falling apart. And I don't believe that someone in the WH wants Fitz to win. The Bush Aministration created a blueprint with his base of money, greed, power, and special favors before the year of 2000. Since Fitz, is a threat to their plans, they want to make sure that he gets removed from this case. The CIA Leak case ties with the war in Iraq, Enron, Tyco, Abramoff, DeLay, 9/11, corporate and oil businesses, the relationship between the Bush family and the Saudias, etc. Administration finds Fitz a threat. Waterflake, good analogy about the Morrison vs. Olsen case. Libby is riding a dead horse. I know that you need to defend yourself to the public because the public is watching this case,. But you don't need to defend yourself to your fellow bloggers. We know who you are....
One more thing, folks,
Keep you eye and ears open on the amount of money in which the Administration has been giving away. Since the deficit is now raised to 9 trillion, when Jackie mention about the fighting within the Administation, I think alot of so-called money in which Congress keeps frisbeeing out to Bush is not neccesry for the war in Iraq but hush money, don't you think? Too many people who are involved and have ties with the Bush Administration who can blow the whistle and bring down the Administration are being paid off. You notice that Bush has had a lot of "backdoor" secret meetings especially internationally. and I wonder which one of Bush' friends who are being paid hush money will blow the whistle on the Administration?
