(WASHINGTON, DC - NOV 28, 2007) – Editors of the ABA Journal today announced they have selected From the Desk of Patrick J. Fitzgerald as one of the top 100 best websites by lawyers, for lawyers.

Now lawyers are being asked to vote on their favorites in each of the Blawg 100’s 12 categories. To vote, go to here. Voting ends Jan. 2, 2008.

Very interesting.


I got into a argument over the week-end with my sons concerning college football and players. It had to do with snarky comments from sportscasters about a college quarterback. I'm not that into sports but I watched a short video on this: (before then)

either on Thursday or Friday of a High School or Jr. High running back that was an extremely good player. I cannot find it now but this is the platform I seen the video on. I don't know who the young man was but you know, one with skills might want to look. If you need me to explain more, I will.

I don't understand communications that much, but looking into that "puzzle" thing...ahem. (not my comment at 8:25)

35,000 Oregon National Guard are going to be backdoor drafted. It's the largest call up in Oregon since WWII. Is the same thing happening in any of your states?

I thought the "surge" was working, but maybe they will be needed for the next blunder in Iran. They will be headed to the Middle East.

11:29, both the SDNY and the central district in CA have PR people who screen media inquiries. The SDNY, for example, "allowed" Dave Kelley to give and interview and be photographed in ways that didn't sit well with many attorneys.

But Randall's response to the media when they didn't immediately run the item about FItz's engagement was telling and troubling. The Chicago office gets off on this nonsense, perhaps because they're not used to celebrity.

Thanks for the handling of the Black prosecution. The sentencing next week has been agreed upon and all parties seem prepared to allow the process to move forward.
I cannot over emphasize the importance of keeping the Breeden Report out of the context of the pre sentence report while the shareholders get their justice.

There sure are some narcissists who post here, but look at the story beneath this one. I think it is a big story, but everyone is ignoring it, both the blogs and MSM. And only five people commented here. If you put the Bloch story together with the ones in which Bush is pushing a "state secrets" policy, you can gather that we are no longer a country of laws. Shouldn't the real Fitz be concerned about that?

The Black prosecution is important for many reasons. I will list only a couple here.
Hollinger Intl. was a Media Conglomerate.
First of importance to you is that it is a story of struggle to control media outlets including a few influencial dailies around the world.
In the nineties the board of directors at Hollinger became controlled by names long associated with US intel agencies.
Please search the Breeden Report from the SEC website. You may find page 472 of particular interest.
I must add that all former directors were cleared of wrongdoing by the authorities and they have letters to prove it. Some testified for the prosecution at the Black trial.

HuffPo has a headliner that the White House has not cooperated with Rep. Waxman in his investigation of the CIA Leak. It says that last summer Waxman and Fitzgerald reached an agreement about what materials F. could turn over to W. without compromising the grand jury testimony and that for his part F. has turned over whatever he could. Waxman has now sent a letter to Mukasey asking for the WH material so Mukasey will be showing what he is made of by his response.

the shooter in omaha bought the sks rifle legally. the adults in the home where he was staying thought it was so old and beat up looking to render it nonoperational.

Then she twists a day-late/dollar-short action on the part of esqs. to defend the Constitution -- saying "little ol' " her was the cause of the movement.

Honey, Dave et al. kept you from any legitimate Fitz info cuz you are batshit crazy. Your "dream date" post divorce was NEVER gonna be him. Never. So you and Christy keep thinking you have a MEGA following. You all failed as prosecutors. Period.

That's funny about LHP because the last time I read FDL or LHP was when Mukasey had been nominated for AG. LHP wrote a piece which repeated Diane Feinstein's weak rationale that Mukasey was going to be the best we could get out of Bush. I thought at the time that LHP was cautiously promoting him because he was a New Yorker, but many of the people on the thread went after her and she retreated.

Andy McCarthy from NRO has a book coming out in March (I think) about the 1993 WTC bombing. I'm sure Mukasey and Fitz will figure prominently. LHP, not so much.

LHP and the other FDL attys all feed off of one another and it gives them a false sense of superiority. About a year ago, LHP was going on and on about Fitz's "Mentor" -- how this guy really impacted Fitz when they were both at the SDNY. I happened to know the guy she was talking about and I posted (which I seldom bother to do over there) that they were never there at the same time. She blamed her whole post on a faulty memory. A LONG post, too.

Christy acts as if she's been championing children's rights for years. Hardly. She was briefly a local prosecutor. She went to a fourth tier law school. She's desperate for attention.

I prefer the smart posters here at Faux Fitz.

6:55 - I have mixed feelings about McCarthy. He was loyal to Fitz even while his fellow Cornerites attacked him. He showed loyalty to his friend while not agreeing with his prosecutorial approach. His (their?) attitude toward torture is very disturbing.

The "left" seems to ignore that Fitz has supported the death penalty and it's a safe bet he's on the same page with McCarthy on many issues.

It's curious to me that Fitzgerald won the Bernardin award when Fitz has such a "pro-death" record and Bernardin was known for promulgating a "consistent ethic of life."

Anon. at 7:02, I was aware of the points you make about Fitzgerald and the death penalty. Also the Patriot Act. I too have always been mystified by the the "left's" adulation of him although I think that is mainly FDL. My husband and I think that he has probably been a good USA for Chicago, but we've always questioned his true role in the CIA Leak case. That and his views on capital punishment and the Patriot Act don't make him a simpatico figure to us.

7:23, Fitz went on and on about the death penalty when he spoke at Harvard in April. The audience started grumbling and he abruptly ended his talk.

The FDL people, like the National Review Online people, are so partisan that they lose their capacity for full reflection.

I agree that Fitz is a good USA in Chicago (and I'm in Chicagoland so I'm usually thrilled with his hardnosed approach). But his image has really been spun. And I don't think it was primarily his doing.

Mr. Fitzgerald should realize that human beings have the right to think, feel and act for themselves. Most people are good, decent people that have broken the cycles of abuse for their children's sake. Perhaps he needs to ask a mother or two something. ;)

If people think others aren't putting the multiple birth thing/ and "happenings" together, they should think again.

7:51, I don't find Fitzgerald to be sanctimonious. He actually is very humble in person and (usually) in the press. But he seems to cling to the "rule of law" in a way that is troubling.

I wish someone more bold had been the CIA leak prosecutor. If it had been someone less concerned with the rules and more concerned with getting the truth out, Bush would not have won a second term.

There's a really poorly written book out called The Ambushed Grand Jury. It was worth reading because it showed what people will do if the crime is egregious enough. In this case, although the grand jury was sworn to the usual secrecy, the govt and a contractor were getting away with murder by mismanaging a plutonium trigger plant. The legal system completely failed, but the grand jury got the word out and closed down the plant.

One more thing about the plutonium case: The whistleblower was a great man named Jim Stone. He spent 18 years of his life fighting the good fight against the plant contractor. His part of the case went all the way to the Supreme Court. They ruled against him. He got the news and processed it with grace (he also had mild Alzheimer's). A few weeks later, he died at age 82.

BTW, Pat Collins works for the law firm that represents the owner of the plutonium plant. That makes me sad.

Dear, "truth" is relative in the political sphere.

While I may have doubts about Fitz personal character, professionally I applaud when our prosecutors hold steadfast to the rule of law, to insure any degree of fairnes in the application of those rules.

A different prosecutor may have had a different outcome. It strikes me as naive of you to assume that potential outcome would have been substantially better.

I'm sure Fitz was masterly skillful in USING all resources available to him.

Prosecutor Fitzgerald's character seems to please some and dissapoint others.

I believe Fitz is perceived as a law and order man. Perhaps this perception is derived from his strict adherence to the rule of law or the fact that he once seriously considered and pursued studies to become a priest.

In any event, I would presume Fitz highly values his own moral standing and acts accordingly, even where the rest of us think he totally lacks human perspective.

Well the TRUTH is that Fitz Jesuit training went past Regis.

Fitz studied to become a Jesuit priest, going as far as finishing Regency. He never started the tertarian phase which leads to ordination.

His "bachelorhood" is all about celibacy, as the window for ordination does not close until a candidate reaches 50 years old.

Is possible that his betrothed "Jenni" may be a "plant" affair to deviate attention from his bachelorhood/celibacy. Jenni is the nice daughter of a couple friend of Fitz.

Any way, it is no longer a secret that he goes around telling different people different things about the "Jenni cover", depending on what better suits his interest.

The press made so much of his single status during the Libby case that Fitz became uncomfortable about keeping his "privacy", though he does not give a damn about anyone elses.

There is no shame in being celibate because of a priestly vocation being put on hold.

The shame is in the lies he has been telling a lot of people, not to mention those he has trampled upon for purposes of advancing his career.

Urgent Appeal

Attention: Governors of States, Secretaries of States, Attorney Generals, FBI Officials, Homeland Security Officials, State Department Officials, Immigration and Customs Enforcement Officials, Federal Elections Committee, Electors and Electoral College, Congressmen, Senators, State, Federal and Supreme Court Judges, Election Officials:

This letter is to put you on notice in regards to the following troubling facts:

1) From August 21 until now some 17 legal actions were filed all over this nation and at least 16 more are about to be filed shortly: those were individual or class actions, in different State and Federal courts. The plaintiffs: US citizens, voters, electors, different Party officials and candidates for office are alleging that Mr. Obama’s eligibility for Presidency was never verified by any governmental agency and mounting evidence suggests that he does not qualify as a Natural Born citizen and therefore cannot be sworn as the President of the United States. These actions were not heard on merits yet. The first action, filed by the former Deputy Attorney general of the State of Pennsylvania, Phillip J Berg against Mr. Obama and DNC, titled Berg v Obama el all is currently in the Supreme Court, awaiting resolution of question, whether a voter has standing to bring an issue of eligibility to court. Regardless of the Court decision on this matter, other parties with superior standing have filed similar actions. A second case has reached the Supreme Court recently. This case was filed by New Jersey attorney, Leo C Donofrio against the Secretary of State of New Jersey Nina Mitchell Wells. Mr. Donofrio states in his legal action that Ms. Wells did not fulfill her duties and did not verify the eligibility of the candidates. For example, she allowed on the ballot not only Mr. Obama, but another candidate, representing Labor party, that admitted that he is not a Natural Born citizen, but was rather born in Nicaragua. The very State and Federal officials that took the oath of office to uphold the Constitution, are trampling all over the Constitution and our rights as citizens to elect a candidate that is eligible to be the President according to the Constitution.

2) Numerous voters, concerned citizens have turned to the offices of the Secretaries of States and found out that none of the Secretaries of States verified Mr. Obama’s eligibility. Routinely the Secretaries of States simply allowed Mr. Obama to sign a form, stating that he is able to perform the function of the President without any independent verification that his statement is truthful and correct.

3) Numerous voters and concerned citizens have contacted the Federal Elections Committee (FEC) and found out that FEC did not do any verification of Mr. Obama’s eligibility either. FEC representatives have stated that they are dealing with financial aspects of the campaign, and even that was not done by the FEC, since for roughly half of the 650 million raised by Mr. Obama, there was no documentation, no names of the donors and there were numerous reports that there is a high probability that at least 65 million came from non US citizens.

4) There was no investigative reporting in the Press, since predominantly liberal media was pushing for Obama for president and was unwilling to show journalistic integrity and investigate or report anything negative in regards to Mr. Obama.

5) Most of the States in the Union contain statues in the election codes, that characterize election fraud or aiding and abetting election fraud, as a felony, punishable by lengthy jail terms. For example, California election statue 18500 states: “ Any person, who commits fraud and any person who aids and abets fraud or attempts to abet fraud, in connection with any vote cast, to be cast, is guilty of a felony, punishable by imprisonment for 16 months or two years or three years”

6) We, the people, the citizens of this country demand that all of you do not aid or abet commission of fraud, do not subject yourselves and others to the possible charges of aiding and abetting fraud and investigate the following facts:

a. according to affidavits presented in the Berg v. Obama to the Supreme Court, Sarah Obama, Mr.Obama’s paternal grandmother has repeatedly stated that Barack Obama was born in Kenya and she was present at the hospital, when he was born, which means that Mr. Obama is not a Natural Born Citizen and not qualified for Presidency. (based on 1952 code)

b. Mr. Obama has responded by posting on his web site “Fight the Smears” a “short version” form of Certification of Live Birth’, but categorically refused to provide a copy of a vault or (long version birth certificate), that would provide for a name of a hospital and a name and signature of the doctor. This is crucial, since the State of Hawaii allows residents of Hawaii to register in the state of Hawaii the birth of their children, born in another state or another country, such as Kenya. Please see in attachment a sample Certificate of Live Birth, Box 7C, asks for the County or State or other country of birth.(this provision exists due to the fact that numerous Hawaiians historically worked outside of the state, mostly on Solomon islands and Guadalcanal). This document also has provisions for the name of the hospital and the name and signature of the doctor. Additionally, Hawaii became a State in 1959, only two years before Mr. Obama’s birth. At a time numerous residents of Hawaii did not have birth certificates, therefore the state of Hawaii allowed residents born from 1902 until 1971 to obtain a different document called Certification of Hawaiian birth, that could be obtained simply by the statement made by a relative without any corroborating evidence. Therefore the short version birth certificate, posted by Mr. Obama on his web site, could’ve been based on an affidavit made by his mother or most probably by one of his grandparents, that he was born in Hawaii, even if he actually was born in Kenya. This could’ve been done not because Mr. Obama’s relatives thought that he would run for president one day, but simply to avoid the hustle and expense of going through some eight years of immigration procedures.

c. As of now no one was able to locate any hospital in Hawaii, any nurse, any doctor that would provide any evidence that Mr. Obama indeed was born on Hawaii.

d. Mr. Obama refused to provide any documents in Berg v Obama case.

e. Mr. Obama refused to consent to release of his vault or long version birth certificate.

f. Mr. Obama refused to consent to release of any records by any hospitals.
g. Madelyn Dunham, his maternal grandmother remained silent and never refuted the statements that Mr. Obama was not born in Hawaii and no access was ever allowed to any reporters to ask Mrs. Madelyne Dunham one single question: “in what hospital on Hawaii was Mr. Obama born?’

h. Even if Mr. Obama would’ve been born in Hawaii (all the evidence states otherwise), he would’ve lost his citizenship by virtue of moving to Indonesia and obtaining Indonesian citizenship. Indonesia did not allow dual citizenship and Ms. Ann Dunham- Obama-Soetoro had to relinquish her son’s US citizenship in order to gain Indonesian citizenship.

i . In 1981, during the ban on travel to Pakistan for US citizens, Mr. Obama by his own admission had travelled to Pakistan. The only reasonable explanation, is that he did it using his Indonesian passport and using his prior name Barry Soetoro or his Kenyan passport, since he was entitled to the Kenyan citizenship, due to his father’s Kenyan citizenship (in 1963 Mombasa area became a part of Kenya), or he could’ve had a passport of British protected person, since at the time of his birth, in 1961, the area of Mombasa (his fathers homeland) was not independent yet (not until 1963) and was called Omani Sultanate of Zanzibar, British Protected Area. (it was ruled at the time by the Royal family from Oman and was part of British Protected areas).

Based on all of the above Mr. Obama was never a Natural born citizen, and he would’ve lost his natural born status, even if he had it by virtue of getting an Indonesian Citizenship, and he has divided allegiance and cannot become the President of the US.
We the People, citizens of the United States of America, demand that you investigate these acts and refrain from certifying the vote or signing the Certificate of Ascertainment (to be signed by the Governors and Secretaries of States before the December 15 vote by the electors.) We demand that the Electors of the Electoral College refrain from signing the Certificate of Vote until there is verification of eligibility of Mr. Obama by properly authenticated documents, such as vault (long version) birth certificate, that shows the name of the hospital and the name and the signature of the doctor in Hawaii, birthing records from the hospital in Hawaii, certified copies of all and any passports held with immigration stamps, particularly immigration stamps from Pakistan from 1981, school enrollment records from Indonesia, Occidental college, Columbia University and Harvard college, that would show citizenship listed at the time of application. We demand that proper investigation would be done and, if the above facts and allegations are found to be true and correct, Mr. Obama be de-certified of the ballot.
